But apparently she soon repent ed of thi s ba rgain, an d add ressed a petition to the Kin g prayin g tha t le manoi r de l a Bayehalle might be res tored t o her, t he grounds f or th e request being tllat t he King s ministe rs had not on ly neg lected to pay the r ent, bu t had let he r houses go t o ruin , a g nt damag e de l ava ntdite Marg i e de xlli. On this the King issued a commission to Henry de Cob h a m a n d others to investigate the matters set forth i n t h e peti ti on, and the direct result of this enquiry w a s a n order f o r the immediate restoration of all the, p ro pert y. The out ly ing estates were to be restored uncon dit ional ly, and i f lan ds had been demised at ferm th e far mers w ere to b e satisf ied for their expenditure o n the l and, wh ile wit h regard t o Bayhall and the land i nclude d in the f ine levi ed in 1320 , there was this savi ng clau se, viz., t hat thi s portion o f the property wa s to rever t to the Kin g in cas e all the pa rties mention ed in the f ine died with out issue. From this order it appears that Thomas Colepeper acq u i r e d the Buxted property mentioned above in 7 Edward I I . , a n d in 13 Edward II. he purchased from Reginald, s o n o f Reg in ald Burgeys, of Boxstede, 1 messuage and 5 0 ac re s in Box ste de and Marsefeld. The 40 acres in Fern th F ran t , co. S usse x, is supplemented in this order b y 10 a cre s of wood b ough t in 10 Edward Il. from Roger , son o f Rich ard de Ferru gge , while another 20 acres i n the sam e tow n is stated t o hav e been acquired from Wi lliam so n of Joh n de Nettewort h.he t ombstone. Unfortuna tely thi s was stol en, and agrea t loss , as a friend wh o in late r years wen t to Branford t o photog raph it, rep orted th e stone no lon ger existed. Such vanda l ism in t hese times is diffic ult to understand , but I f ear m any o ld tombstones have go ne, giving way t o impro vements. I, p. 5 9 6 Daniel s son William evidently never married and Dan i e l s son John would have been but nine years of age i n 1 73 1 hence must have died in his boyhood. Esther Maltbie, Executor of Daniel Maltbie, late of B r a n f ord, Dec d exhibited an Inventory of Said Decease d Es ta t e w hich was approved and ordered to be Recorded. From Maltby Maltbie Genealogy, by Dorothy Maltby Verrill Daniel Maltbie Maltby, son of William was a farmer b y o c c u pation. Wh en his father died, he left most of th e la n d a n d the farm to Daniel. Daniel, like the rest of his family, was active in t h e C o n gregational Church of Branford the same churc h hi s fa th e r helped found. He bec ame a Deacon of the c hurch. After his father died, Daniel became the legal guar d i a n o f his younger brother John or Jonathon as he wa s la t e r know n. Daniel was 18th on the list of Freeman of Branfo r d t h i s was a mar k of community distinction and prom in ence. According to family records, Daniel fought in the In d i a n W ars. In the inventory of his estate a sword is li s t e d tes timony to his military service. Daniel and Esther Moss were married at the Branford Co n g r e gational Ch urch on 27 October, 1702 by the Revera n d Sa mu e l Russell. Esther was als o from a prominent f am ily , he r f amily being old friends and fellow church m emb ers. Daniel Maltbie is buried at the Old Burial Grounds a t B r a n ford. His grave is near his father and mothers . Hi s t om bs tone no longer stands due to vandalism. In 1700, Daniel Maltbie joined the Church at Branfo r d . E sther Moss , who was to become his wife, joine d t h e ch urc h at the same time. They were married Oct. 2 7, 1 70 2. B ranf ord Record . Rev . Branford Rec., Vol. I, p. 224 June 14, 1703. Dan i e l M a ltbie entered his ear mark, which is a crop on t h e to p o f b oth ears, and a hollow crop on the near ear . Vo l . II , p . 249 April 12, 1705. At a meeting of the Proprietors in B r a n f ord com mencing March 25, and closing April 12, 17 0 5 , Da ni el Maltbie desire d them to give him about 2 ac r e s of se dg y land, which was granted.
