"The Old Academy lots at Third and Princess Streets were purchased by the Town of Wilmington in July 1854, but probably plans for a theatre and town hall on the site had been under consideration for some time." "Plays continued to be given in the Old Academy theatre until the Town finally acquired legal title to the land in May 1855. Mayor O.G. Parsley and Isaac Northrop were appointed a committee to execute plans and arrangements with the Thalian Association. " Enough of the foundation had been laid to permit the cornerstone ceremonies on St. John's Day, December 27, 1855. In the name of God, Amen! I, Isaac Northrop of the town of Wilmington, in the State of North Carolina, being of sound and disposing mind and memory, do make ordain and publish this to be my last Will and Testament.
First I desire and direct that all my just debts be paid as soon after my death as can conveniently be done; and to that end I authorize and empower my executors of my estate, real and personal in such way and upon such terms as may be deemed most advantageous; and in their discretion to make the proceeds of any real estate so sold, the primary fund for the payment of my debts to the exoneration of the personal estate.
Second I give, devise and bequeath all the rest and residue of m;y estate of every kind, and whereso ever situate, after the payment of my debts, to my beloved wife Susan. until my youngest living child shall arrive at full age, or marry, in order to enable her to live in comfort and maintain and educate my younger children; and upon the arrival at full age, or marriage, of my youngest living child, as aforesaid, then I give on third of all the said residue of my estate real and personal, to my said wife Susan, absolutely; and the other two thirds to be divided among all of my children in such a way that the shares of all shall be equal, except my daughter Caroline Carr, whose share shall be less in value by one thousand dollars, than the shares of my other children.
Third In case my wife should die before the arrival at full age, or marriage, of my youngest living child, then upon her death, I give devise, and bequeath the whole of my estate, real and personal after payment of my debts, to my executor hereinafter named until the arrival at full age, or marriage of my youngest living child; in trust, however, during the period aforesaid, to apply the annual income, rents and profits of my said estate, to the comfortable and genteel support, maintenance and education of my minor children who are unmarried; and if the income of my estate shall be more than sufficient for the support and education of my minor unmarried children, then all such surplus income beyond what is requisite for that purpose, shall, during the period aforesaid, be annually divided equally among all my children; and upon the arrival at full age, or marriage, of my youngest living child, I give the whole of my said estate to be equally divided among all of my children, except my daughter Caroline Carr, whose share shall be one thousand dollars less in value than the shares of my other children, as before declared.
Fourth If any of my children shall die before the division of estate as directed in the two preceding clauses, the issue of each and any child so dying (if such issue be living at the time of said division) shall represent their parent, and take the share of my estate which such parent would have taken if living.
Lastly, I constitute and appoint my wife Susan and my son Samuel to be Executrix and Executor of this my will.

Signed published & declared by the testator as his last will in the Isaac Northrop ((signature) presence of us, who in his presence (seal) and the presence of each other, and at his request, have subscribed the same as witnesses.

State of North Carolina New Hanover County Court, December Term 1862 This paper writing, purporting to be and contain the last will and testament of Isaac Northrop deceased, is exhibited in open Court by Samuel Northrop the Executor therein named, and offered for probate, and the due execution of the same by the said Isaac Northrop, was proved by the oath and examination of John A. Taylor and Wm. T. J. Vann, both the subscribing witnesses thereto, and it is considered by the Court, that the said paper writing is the last will and testament of Isaac Northrop, in every respect, and sufficient to convey the bequests therein made. It is ordered that the same be recorded.
