General Notes (Wife)

------------------------------------------------------- - - - - ----------- ----------

Sarah Tuttle was merely a flirt, but two separate inci d e n t s have guaranteed her place in history. At a cour t h e l d i n New Haven, May 1, 1660, Jacob Murline and Sar ah T ut tl e we re prosecuted for "sinful dalliance". The y wer e acc use d o f "sitting down on a chest together, hi s ar m abou t he r wais t and her arm upon his should or ab out h is neck , an d contin uing in this sinful position ab out ha lf an ho ur, i n which t ime he kissed her and she k issed h im, and t hey ki ssed one a nother", as the witness es testi fy. This c omplain t was mad e by Sarah's father u nder a la w that whos oever sh ould invei gle or draw awa y the affect ions of an y maid or m aid servan t for himsel f or others , without fir st obtainin g the consen t of he r parents o r guardians, sho uld pay, bes ides all th e dam ages the par ent might sustain , 40 shilling s for the fi r st offense, a nd for the secon d towards the sa me perso n , 4 pounds an d for the third, fi ned, imprisoned a nd co rpora lly punish ed, as the Plantatio n court may direct.

The term "inveigling" appears to have had rather wide i m p l i cations. There were cases in which the young man ch ar g e d wi th this offense had done nothing more than to w al k w it h th e girl on a country road. Young women who co nse nte d t o adva nces from the men were also looked upo n wit h leg al d isfavor . Mr. Tuttle pleaded that Jacob ha d ende avore d to s teal awa y his daughter's affections.

Additionally, the Governor declared that "the busin e s s f o r which they were warned to the Court he had hea r d i n pri va te at his house which he related to stand th us ; o n the d a y John Potter was married, Sarah Tuttle we n t to M r. Murli ne 's for some three hours. Mr. Murline b i d her g o to her d aug hters in the other room, where th e y fell int o speech o f Joh n Potter & his wife, that th e y were both l ame, upon w hich S arah Tuttle said that s h e wondered wha t they would d o at ni ght whereupon Jaco b c ame in a took e away or took u p her glo ves; Sarah des ire d him to give h er the gloves, t o which h e answered h e wo uld do so, if sh e would give hi m a kiss, up on whic h the y sate downe toget her, his arme be ing about h e r & her ar me upon his shoulde r or about he nec ke & h e kisse d he r & shee him, or they k issed one another , co ntinuin g i n this posture about hal f an houre. Mrs. Mur l ine no w in Cou rt said that she hear d her say, she wonder e d wha t they woul d doe at night & sh e replied they mus t sle ep , but there wa s company with he r in the roome, a nd sh e w as in a strait; b ut it is matte r of sorrow & sh ame t o her."

Jacob was asked what he had to say to these things; t o w h i c h he answered, "yes he was in the other roome & w he n h e h ea rd Sarah speake those words he went in, wher e sh ee h avei n g let fall her gloves, he tooke them u p & she a ske d him f o r them; hee told her he would if sh ee would k iss e him whi c h she did; further said that h e tooke her b y he r hand & t he y both sate downe upon a c hest, but whet her h is arme wer e a bout her & her arme up on his shoulde r or ab out his neck , h e knowes not, but h e never though t of it s ince, till Mr . Ra ymond told hi m of it; for whic h he was b lamed & told t hat i t appeare s that he hath no t layd it t o heart as he ou ght. B ut Sa rah Tuttle replye d that shee d id not kiss him ; but Sar a h being asked if J acob had invei gled her, she sa id, no ; th o Tuttle said th at he came to t heir house two o r th ree time s before he w ent to Hollan d & they two were to g ether & to w hat end h e came he knowe s not unless it we r e to inveigle he r & th eir mother warne d Sarah not to k ee p company with him . Ja cob denyed that h e came to thei r hou se with any such in t ention nor did i t appeare so t o the Co urt. The Governor t o ld Sarah that h er miscarria ge is the g reatest that a vi rgi n should be s o bold in t he presence o f others, to car ry i t as she ha d done & t o speake such cor rupt words, mo st of t he thing s charge d being acknowledge d by her self , though th at abo ut kis sing him is denyed, ye t the thin g is proved. Sa ra h prof essed that she was sorr y that sh e had carried i t s o foo lishly & sinfully which sh e see s to be hateful; s he ho p ed God would help her to carr y i t better for time t o com e . The Governor also told Jac o b that his carriage ha t h been e very evil and sinfull, s o t o carry towards he r ; & to mak e such a light matter o f it a s not to think e o f it (as he h ad exprest) doth gre atly agg ravate."

Sarah was characterized by the court as a "bold virg i n " w h o had better mend her ways. She said meekly tha t s h e woul d . Jacob was set free and told to shun such v irgi n s as Sar ah . The Court declared, "that we have hear d i n th e publiqu e m inistry that it is a thing to be lam ente d tha t younge p eopl e should have their meetings, t o th e corrup ting of the mselv es & one another; as for Sa rah T uttle, he r miscarriag es ar e very great, that she s houl d utter so c orrupt a spee ch a s she did concerning t he pe rsons to be m arried & tha t she s hould carry it i n such a n imodest, unc ivil, wanton , lascivi ous manner , as hath b eene proved ; & for Jacob, hi s carriag e hat h beene verr y corrupt & si nfull, such as bri ngs reproa c h upon the fa mily & place; t he sentence therefo re concer ni ng them was , that they shal l pay either of the m a s a fine 2 0 shilli ngs to the Treasu rer."

Sarah Tuttle died at the hands of her brother, Benj a m i n o n November 17, 1676. Twenty-nine year old Benjam i n ma d e hi s family's name in history with that rather i nd elica t e inst rument, the ax. That night he began quarr eli ng wi t h sister , Sarah. A fragment of paper preserve d i n the C T S tate Arch ives contains a statement by Benj amin.

In it he said that he was with his sister, that the y h a d h a d a falling out, that he was afraid she would d o t o h im w ha t he had done to her, and that he had no lo ve f or h er. H e a nd Sarah may have been arguing about th e div isio n of th ei r dead father's considerable property , or p erhap s Sara h mad e a disparaging remark about thei r siste r, Eli zabeth , who w as showing signs of an impetu ous natu re an d lack o f decoru m which was quite at odd s with th e Purita n standar ds of th e day. Benjamin may h ave remind ed Sara h that she w as no ang el; she had scand ilized th e town i n her youth b y publicly e xchanging kis ses wit h a Dutch sa ilor, for whic h she and th e sailor w ere fine d.

Whatever the quarrel was about, Benjamin resolv e d i t i n a t errible, final manner. He went to the barn , g ot a n ax , retu rned to the house and struck Sarah o n th e head , "mau llin g & mashing her head to many piece s i n a barbar ous an d blou dy maner." Benjamin then ran a wa y and hid i n the woo ds, bu t was later apprehended an d tr ied and conv icted fo r the mur der May 29, 1677.

An official record of the case appears in Crimes, o p . c i t . Document No. 80:
