BIO: The following is an excerpt from one of Eva McCARTY's letters to compiler:
"David was one of the sons who fought on the Union side during the Civil War. He enlisted at Boston, KY on the 10th of March 1862, as a private in Company F, 6th Tennessee Vol. Infantry. He was described as 5 ft. 8 inches; complexion fair; dark eyes; black hair, and occupation, farmer. He was detailed to the Pioneer Brigade, 3rd Battalion, Army of the Cumberland. National Archives records show he fought in the Battle of Chattanooga, Atasona, Murfreesboro and was with Sherman on his march to the sea. During his enlistment, he came down with malaria and was honorably discharged at Nashville, TN on the 24th day of March 1865. On the LAY property was a cave which became known as the "Dave LAY Cave" because he hid his troops in it during the war. Also, the family hid their valuables in it. My mother said she had been back into it for about a mile and it was very cold. On a 1900 census report, David had 900 acres of land in Campbell County, TN. The year is unknown, but David and Elizabeth moved to Oklahoma and then to Baca County, Colorado. It is said that Elizabeth was blind at the time of David's death. He had asked to be laid out under a big tree in the front yard and when they brought Elizabeth out for the funeral, she looked down at the casket and said, 'doesn't he look pretty?'"
May, 1997: Compiler established contact with Steve STAMM, a descendent of David L. and Annis Elizabeth "Lizzie" LAY. Mr. STAMM contributed more information on this couple in an e-mail message on 25 MAY -- "David LAY was buried in the Lay's Chapel cemetery. Later all the graves in the cemetery were moved to the Springfield Cemetery by Nancy Taylor (LAY) PARKER the daughter of David and Annis LAY. In the Lay's Chapel Cemetery there was a white marker that stood by the grave marking it as the grave of a Civil War veteran. We think that this marker was pushed into the open grave after the exhumation of David LAY's remains because it is not currently standing in the Springfield cemetery..." Concerning the occupation of David LAY, Mr. STAMM writes, "...He was also a veterinarian and mill operator. I have a copy of one of his veterinarian's log books. This book seemed to have been used mainly to keep notes about trips and other day to day events. Just before he moved to COLORADO, he was operating a mill. It was just below "Dave Lay Cave." My grandfather, Merl O. PARKER said that the water that ran out of that cave was very cold. He said that they used to keep much of their perishable food there. I think that I have identifed the mill as the "Blind Graves" mill that was still standing when TVA flooded the whole place in the 1930s..." To compiler's comment above that "the year is unknown, but David and Elizabeth moved to OKLAHOMA and then to Baca County, COLORADO," Mr. STAMM responds with, "The year is now known! I'll transcribe a note written by Annis Elizabeth LAY in 1915 which details their move to COLORADO from TENNESSEE." (See Annis Elizabeth TAYLOR biography, computer #1100.)

BIO: The wife of David L. LAY, son of Jack and Polly (O'DELL) LAY was first identified by Bill HEINLE, a desc. of David's younger brother, Elijah LAY. Later Eva McCARTY, a desc. of Elisha LAY, Elijah's twin brother, wrote the following about Annis Elizabeth: "...David married Annis Elizabeth TAYLOR on Sept. 9, 1866 Campbell Co. TN. I don't know the year David and Elizabeth moved to Oklahoma and on to Baca County, Colorado. David passed away July 17,1927 in Baca County Colorado. Told to me by Billie Lou Phillips Dayton, Ohio grand daughter of David and Elizabeth. Elizabeth was blind at the time of David's death. Billie Lou said, that David wanted to be laid out under a big tree in the front yard, and that when they brought Elizabeth out for the funeral, she looked down in the casket and said, 'doesn't he look pretty.'"
Per the 1870 census "Ann" was 22 years old; she was born in TN. On the next census for Campbell Co., "Anis E." was enumerated as "34." On the latter, she reported her father born in SC and her mother in NC.
May 1997: Compiler established contact with Steve STAMM, a descendent of David L. and Elizabeth (TAYLOR) LAY. In an E-mail message on 25 May, Steve wrote the following in response to a statement by compiler that the date was not known for the move of this couple to OK and CO, "...The year is now known!...a note written by Annis Elizabeth LAY in 1915 which details their move to Colorado from Tennessee. The Lay Trip West David Lay and Lizzie Lay started from Tennessee on January 27, 1913 got to Liberal Kansas Feb. 1. Went to Lizzie Nickardsons, a daughter, in Lorena, Okla, Feb 2nd, then went to see the rest of the children. Celia McNew, Dave Lay, Eva Meltabarger etc. stayed in Oklahoma until March 28, 1914, then came to Baca Co. Colorado. Got here April 2, 1914. Stayed at the Meltabargers, (who had come on out from Okla the last of April 1913) until the 17th and filed on our claim and planted our crop and stayed here til the 6th day of August, then went back to Oklahoma to see the children. Came back here the 6th day of Sept and gathered our crop, then went back to Oklahoma the 3rd day of Dec and stayed until the 25th day of Feb. and got back here the 3rd day of March. Was 7 days on the road. Drove through the snow a little every day except one day and a half we stopped. And it snowed most all the time on our trip. Wrote by Lizzie Lay this March the 13th 1915
01 June 1997: Steve STAMM mailed the first of several packets of information on the LAY family to compiler. This one contained a photocopy of the death certificate of Annis E. LAY, which provided the identities of her parents, her birthplace and date of birth, the place of birth of her father, and the name of the cemetery wher she was interred. The informant for the death certificate was Mrs. H. M. PARKER, "Lizzie's" daughter, Nancy P. PARKER.

BIO: George William LAY was enumerated as "William, 3," on the 1870 census. In 1880, he was listed as "George W., 13. " Concerning this son of David L. and Elizabeth (TAYLOR) LAY, Eva McCARTY writes, "George Wm. was a Doctor. He married Anne E. BURNETT in Dec. 1893. They had three children... George Wm. known as "Doctor Will" was on his way to Knoxville, TN. when he was struck by a train in Powell, TN and died in a Knoxville Hospital." After proofreading compiler's transcription of the biography of George W. LAY, Mrs. McCARTY corrected the date of this couple's marriage from "?? DEC 1893" to "11/6" (1893); compiler assumed this was intended as 06 NOV.

BIO: Of Lizzie G., Eva McCARTY writes: "Cecelia Ann and Lizzie G. both had children from Cecelia's husband James McNEW. The story is that when this happened the husband left Tennessee and settled around Liberal, Kansas. He sent for his wife Cecelia, and asked her to bring her sister Lizzie, which she did. From what I have found out Lizzie had another child by James after they were in Kansas. Sometime later after they were in Kansas Lizzie married a man (by the name of) Judgeson Nickerson. Her first child which was by McNEW was raised by sister Cecelia. After Lizzie married NICKERSON she supposedly had (the second) child by McNEW. This boys name was Eskar. When Cecelia passed away Lizzie married McNEW."

BIO: Elijah is the direct-line ancestor of William J. Heinle who has provided much of the data for the Jack LAY and Mary Pauline (O'DELL) LAY families. Elijah was a twin to Elisha LAY. A photo sent by Mr. HEINLE, shows both twins in Civil War uniforms. Elijah and his twin, Elisha, as young boys, are said to have served as messenger boys for the Union Army during the Civil War. Steve STAMM, another descendent of the LAY family located via the computer genealogy network, has as part of his LAY home page, a list of "LAYS WHO WENT TO WAR." Per that list, Elisha LAY was a private in the "154th TN Inf., Co. B. Senior Reg.'s" Elijah is not included in this list. Elijah and his wife, Mary PETREE, had ten children, but only six lived to adulthood. Per Eva McCARTY, "Mary explained that Tennessee was a hard place to raise children because there was so much fever..." Mrs. McCARTY goes on to tell of Elijah's migrations from Campbell County TN to Marion County, and later to ARIZONA. "Sometime in the late 1870's or early 1880's, Elijah built two barges and loaded his family and all their possessions... They made their way down the Powell River into the Clinch River to the Tennessee River and then on to Rankin's Cove where his brother, William Quillen, had a farm. Elijah was was to work for William...in the 1880s, Elijah's son, Dave left Rankin's Cove and went to AZ where Elijah's brother, "Johnny" and his wife,...'Aunt Mack'... and daughter, Jennie...settled on the lower Verde River...Elijah was never satisfied in TN after Dave left home. As soon as he could, he gathered his 1rops and sold his home ... the next year, he and his wife and five children embarked on what was called an immigrant train from Jasper, TN... They arrived in Prescott, AZ on March 22, 1892. They still had two more days of hard travel before reaching the Verde Valley where Dave had located. When they arrived, the military at Camp Verde was having trouble with the Indians. They found land to rent, but the Army would not allow them to live in their tents as they had planned, so they lived in part of the adobe building that is now the Fort Verde Museum. Elijah homesteaded in Oak Creek Canyon near present day Sedona. The family finally settled in Cornville on lower Oak Creek. He farmed and ranched with his son, Joe, until his death. Mrs. McCARTY has provided a photocopy of the obituary for Elijah LAY; the article is accompanied by copies of photographs of Elijah and Mary Ann. A copy of this page is included in this genealogy.

BIO: Eva McCARTY writes, "Elijah was the sixth or seventh child, as he was a twin... He married Mary Ann Petree, the dau. of Isaac and Martha Emaline (FORD) PETREE. Jan., 1997: Compiler had taken the liberty of entering the names of Isaac and Martha PETREE as the parents of Mary Ann using data found on the 1860 census, with an eye to comon given names, etc. After Mrs. McCARTY's letter, compiler returned to examination of census films. 1870 shows a John and Catherine PETREE residing next door to the young couple in Campbell Co. Isaac and Martha PETREE appeared two pages and 16 households later in the '70 enumeration. Both John and Isaac are enumerated as "44" years old, both born in TN. Compiler is now doubtful that she has located the parents of Mary Ann PETREE accurately...thus emphasizing the dangers of "assuming" in the work of genealogical research!!! As of 20 Jan. 1997, compiler has not located a "John and Martha PETREE" on either the 1860, 1870 or 1880 census for Campbell County, TN. "Mary" (PETREE) LAY was enumerated as 28 years of age on the 1880 census. Elijah and Mary Ann had only four children on that enumeration -- William, David, James "A.", and Sarah J. In recording the data on the children of Elijah and Mary Ann (PETREE) LAY, compiler's attention was snared upon listing the sixth child of this marriage -- "Lou Catherine." Returning to the census data collected over the years, compiler looked again at John PETREE's household to find that the wife of John PETREE, who in 1870 was enumerated as "Catherine", appeared in 1880 as "Loucathrin". The LAYs had named their first daughter Sarah, this second one "Lou Catherine" and not until the fourth daughter, did they use the name "Martha." On the other hand, they named their second son "John David" and apparently never used the name "Isaac" for one of their sons. These clues seemingly do nothing to help in answering the question of the given names of Mary Ann PETREE's parents. BIO: James "A." was five years old, the third son of "Elija" LAY enumerated in Campbell County, TN in 1880. Concerning the marriage of James, Eva McCARTY writes, "Ella" (DAVIS) "married Joe LAY's brother James Robert LAY, (who was) called Doc..." This family is said to have gone by handmade barge down the Powell River, into the Clinch River and down the Tennessee River to Rankin's Cove in Marion County, TN. They eventually migrated, via an "immigrant train" from Jasper, TN to ARIZONA (1892), finally settling in Verde Valley area. Since Lavisa LAY and her husband were already in ARIZONA and had raised Ella DAVIS after the death of her adopted mother, compiler assumes that James Robert and Ella married in AZ.

BIO: The following article was photocopied and sent to compiler by Mrs. Eva (WELLS) McCARTY:
JOE LAY Joseph Lewis LAY was born April 10, 1884 in the Powell River Valley of Claiborne County, TENNESSEE. He was the seventh child of Elijah and Mary Ann PETREE LAY. As a young boy he floated down the Tennessee River on a barge to Rankin's Cove with his family. At eight years old he traveled to ARIZONA on an immigrant train. It was on this trip that he decided on his lifelong occupation. He wanted to be a cowboy. A neighbor gave him a "dogie" calf and when his father's cow had twin calves, his father gave them to him, together with a white heifer, so Joe was in the cattle business. When the big snow of December 1898 came, Joe put his cattle in the cornfield and they all died from eating smut on the corn. After losing his whole herd, Joe irrigated the alfalfa fields while his father worked away from home, and saved enough money to buy more cattle. His brand at that time was (a symbol representing) "T F open A" Soon afterward he had matrimonial ideas and had to sell his cattle to get money to build a house on the place his father had bought. Later he bought the (symbol) "Flying U Quarter Circle," brand from William LOY. I guess the daughter was included in the deal, for on December 23, 1906 Joe LAY and Inez LOY were married at the HURST ranch. In 1908 the family made another move, this time to Sedona. Elijah LAY homesteaded forty acres on the east side of the creek, south of the bridge and Joe took forty acres joining it farther down. They built two houses on those homesteads. Elijah and Joe LAY sold their homesteads to L.E. HART and his son, Ed, about 1913, and sold the Flying U cattle to Ira HART. Soon afterwards they bought the (symbol) "Figure 2 Bar," cattle and the Clay PARK ranch from Walt and Lee VAN DEREN. C.B. WILSON, an attorney in Flagstaff, said at the time, if it were not for the fellows south of town trading so much he would starve to death. In 1917 the LAY families sold their ranch and cattle to Fred and Les MICKLE. The William LOY family sold their interest in the XL cattle and the two families bought adjoining farms at Cornville. The senior LOYS and LAYS spent the rest of their lives there. After living on the Cornville ranch forty-five years and raising and educating seven children, the Joe LAYs moved to Cottonwood to retire. On December 23, 1976, Joe and Inez celebrated their 70th wedding anniversary. In 1981 at the age of 97, Joe LAY passed away and Inez followed in 1986 at the age of 96. Both are buried in Cottonwood Cemetary.

Per Mrs. McCARTY, the twins looked so much alike that most people could only tell them apart when they were standing together; Elisha was the shorter of the two. A picture sent to compiler by Wm. HEINLE showed these two very young men in what appeared to be Union Army Uniforms. Mrs. McCARTY explained several years later, that the boys were too young to participate in the actual fighting in the Civil War, but both served as messengers for the Federal troops. Per Ms. McCARTY, Elisha LAY died at Oklahome City, at the home of his daughter, Izora. Elisha and his first wife, "Liza" SWEAT, were both very young when they married, sometime in 1867. Their first child, born in 1868 died at birth; scarcely two years later, the second child, Mary, was born. Elisha LAY was working in INDIANA with his brother, William Quillen Lay, in the lumber business when his son, William, was born. Shortly after the birth of William, Eliza was diagnosed with TB. They immediately moved back to TENNESSEE where she died, leaving a 3 month-old son. Elisha, with three small children, met and married Martha WILLIAMSON soon after Eliza's death. Lavisa, the third of the couple's children, and little William referred to Martha as their mother. Elisha was never satisfied in one place. They lived several places in Campbell County, a while in Sequatchie Valley, TN, and back to Campbell County. In 1897, he, Martha and daughter Lavisa with her husband, Jesse Jackson ELDER left TN by train for Oklahoma. They got off the train at Weatherford, OK. Lavisa and Jackson ELDER stopped at Yukon, OK, then later moved to El Reno, where they settled down. Elisha and Martha traveled from Weatherford to Dewey County, OK by wagon. They settled on land located about 3 miles east and 2-3 miles north of Putman, OK. Mrs. McCARTY writes:
"They lived in a dugout that leaked when it rained and the snakes could crawl in. Here they lived through drought and blizzards so bad they nearly froze to death. Cattlement didn't like the Sodbusters and weren't the easiest people to neighbors along side.. They went hungry many times. Lots of quail, squirrel and rabbits ended up on their table. 'Guess that's why Elisha and his son Richard became expert marksmen. They hunted with a muzzle loaded gun when a miss meant no food. The Lays farmed and raised a few cattle, but Elisha was a carpenter and built homes in the area. Sometimes pay was vegetables, meat or a little cash. Sometimes he walked 10 to 12 miles to work. He was a faithful Mason and walked many miles to lodge meetings at night. Martha was an Eastern Star member. Martha passed away in the early 1900's...After her death the family separated -- some to return to Tennessee and others to remain in Oklahoma... Elisha spent the rest of his life traveling to Tennessee, California and Oklahoma to visit and live with his children. He never unpacked his trunk. ...He had no religion. He did not believe in God... Elisha Lay and his son-in-law Jesse Jackson Elder built a beautiful house on the John "Jack" Lay farm in Campbell County, TN on the Powell River. This is where Jesse met Lavisa Lay. After Jesse and Lavisa returned to Tennessee from Oklahoma, they lived in this home until his death. Lavisa stayed there until the TVA bought the land." Eunice (LAY) PLUMMER's autobiography contained the following remarks about her grandfather, Elisha LAY -- "As a small girl I had bad ear aches. My grandfather Lay would get up during the night and light his old pipe and blow smoke in my ears. He was about 81 years old at this time. Then there was the skunk oil that was used on baby sister (Violet) when she had the croup. These were some old time remedies used by Grandfather LAY that really did work..."

BIO: Lavisa would have been about 4 years of age when her natural mother, Eliza (SWEAT) LAY died. Her father, Elisha LAY, married again within a year of Eliza's death. Martha (WILLIAMSON) LAY was beloved by this step daughter; per Mrs. McCARTY, Lavisa considered Martha her "real mother." Quoting Lavisa, Mrs. McCARTY write, "Lavisa said, Martha was the most kind and loving person she has ever known." The 1880 census shows Lavisa LAY as "Visa"; her age is recorded as "6". (This is not in agreement with the date of birth cited for Lavisa by Mrs. McCARTY.) Jesse and Lavisa left Tennessee in 1897 and lived in Yukon and El Reno, OK. They returned to Tennessee in 1905 and lived in a section of the "Jack" and Mary Pauline (O'DELL) LAY farm. During their time in OK, the ELDERs had numerous "visits" from the Indians in the area. Several times, Jesse and Lavisa had horses taken from their land, but on one occasion, the Indians took the ELDERs' daughter, Perry Martha. Lavisa and another daughter, Mossie, chased the Indians' wagon and were able to get the child back safely. Mrs. McCARTY writes, "They said Perry was having fun, sitting in the wagon, playing with the Indians' beads." Cyclones were frequent in the area where the family lived in OK. It was not unusual for them to spend a whole day or a night in their "cyclone cellar." The family returned to Campbell County, TN in 1904, buying from a cousin the house that Jesse ELDER and Elisha LAY had built for a son of Elisha's brother, David. Jesse died there, and Lavisa remained in the house until the Tennessee Valley Authority purchased the land to flood for the backwaters of Norris Dam. She then moved to Jacksboro, TN; later she lived in Wartburg, then in Clinton, TN with her children. She died in the home of her daughter, Perry Martha, at Oliver Springs, TN. Of her grandmother, Mrs. McCARTY writes, "For the love of two of her sons, Elisha and Marion, she ended up with nothing. The two sons squandered away all she had." A notation on Lavisa's family group sheet, returned to compiler by Eva McCARTY, reads: "Married...Home of the Bride by Rev. Newton CANNON." (June, 1997)

BIO: According to the family biographical information provided by Eva McCARTY, William was born while his father was working for his brother in INDIANA. Shortly after his birth, William's mother was diagnosed with T.B.; she died soon after Elisha moved her back to TN. Elisha then married Martha WILLIAMSON, who William and his sister, Lavisa, accepted as their mother. Per Mrs. McCARTY, William's and Sally's fourteen children were:
Oscar M. (s.o. William 1876) Lay, probably not in GEDCOM Terley Lay, Curtis Lay, Fred Lay, Dennis Lay, Milas Lay, Taylor Lay, Jesse Lay, Wanda Lay, Lou Lay, Harriett Lay, Lola Lay, Gertrude Lay, and Mable Lay.
No other data was given. William and Sally stayed in Tennessee and had fourteen children. When they had their first child, a midwife and a doctor were with Sally. Apparently William watched the proceedings, as he was the one who delivered all the rest of their children. There was never a doctor or a midwife for the last thirteen.

BIO: Elisha married Martha shortly after Eliza, his first wife, died. Martha, at the time was working for his brother, David. Martha never knew who her father was. She was illegitimate. Martha's mother, Nancy, who lived with Elisha and Martha, was known by the family as "Granny." Eva McCARTY writes that her mother remembered "Granny" telling how her father would not allow her to marry Martha's father. She would not tell who he was and thinking to spite her father, she had two more children by him. As far as anyone knows she never told her children who their father was. In 1897, Martha and Elisha traveled by train to Dewey County, OK, with Elisha's daughter, Lavisa and son-in-law, Jesse Jackson ELDER. The ELDERs' daughters, Mossie Lee and Harriett Manerva, and their children were with them. Izora, the baby, cried all the first night. Arriving at Weatherford, OK, they then took a wagon on to Dewey County, where they settled on land 3 miles east of and two or three miles north of Putman. There, according to Mrs. McCARTY'S grandmother, the hard times began and then stayed with them until Martha died. The dugout where the family made their home leaked when it rained and snakes creeped into the house. Elisha farmed and raised a few cattle, but he was a carpenter by trade, and farming was not his forte'. Later, Elisha helped to build several homes in the area, but he never was able to construct one for his own family. Martha never liked OKLAHOMA, and had a fear of having to die inside the dugout. One day when she was doing the washing, she called for her son, James Lewis to throw out a big tub of water for her. When "Jim" did not immediately come to do as his mother asked, Martha emptied the water herself. In the process of lifting the heavy tub, she injured herself internally, causing internal bleeding. Apparently the bleeding continued for several weeks untreated, and was ultimately the cause of her death. In her last hours, Martha insisted that she be removed from the dugout, so her son, David Richard, helped to carry her outside. She was placed under the shade of a tree where she lay until she died. David Richard reported that to be the longest, saddest day of his life. After Martha's death, the family would take her baby, Izora, to the cotton fields while they picked cotton. Placing the baby on some cotton sacks, they would pull her along with them as they worked their way down the rows of cotton, and Izora would cry for her mother. As soon as the family earned enough money to pay their passage back to TN, they separated -- some staying in OK, others returning to TN as Martha had wanted so badly to do. Elisha returned to TN, but in later years, he went back to OK and stayed for a while, first with one child, then with another until his death.

"My father, David LAY, after the death of his mother, came to the Berlin area in the early 1900s. He told that he worked many a time from daylight to dark for 50 (cents) with room and board and was proud to have the job. He borrowed money from a Mr. BARNES for 20% interest. Money was hard to earn and equally as hard to borrow in those days. My father and mother met at a farm sale. He wanted to know who the lady was with so much beautiful red hair... My parents raised cattle, hogs and lots of garden and fruit... ...In the early 1930s there was a free Bar-B-Que at Berlin with a brush arbor for shade. There was speaking and a rodeo in the afternoon. Dave LAY and Joe HARRINGTON were in charge of the Bar-B-Que with lots of good assistance. It was necessary to stay up all night cooking the meat over a pit of red hot coals. Six or seven beefs were cooked. People donated beef, money, coffee and bread for the feast. One year so much coffee was donated that a confiscated still served as the coffeepot. Shorty JOHNSTON was a young boy at that time, and was let down inside by a rope to clean and wash out the moonshine from the still. During the flash flood at Cheyenne in early 1920s Papa worked for the county. He helped search for survivors or victims of the flood. He identified bodies and helped bury or burn animals killed by the flood to keep down germs, flies, etc. He worked for the county several years, building roads and bridges. He was the boss of the road crew. A lot of time he worked men who were serving county jail sentences. ...My parents Dave and Violet (LAXTON) LAY lived to celebrate their 50th Wedding Anniversary plus 7 more years...Papa died in January of 1977 at the young age of 92. He was also buried in the Berlin Cemetery."
The following excerpts have been taken from the work of Gilbert LAY, deceased, author of a book on the LAY Genealogy. The section on David Richard LAY's family history, has been copied and sent to compiler by Eva McCARTY (June, 1997). McCARTY.
David LAY, a son of Elisha and Martha WILLIAMSON LAY, was born in Marion Co., Tn. Dec. 21, 1884, near Lookout Mountain, Removed into Campbell Co., Tn. and lived on Powell River, later lived in Union Co. Long Hollow was the Post Office. Then in 1899 came into Canadian Co., Oklahoma and nine months later into Dewey County, near Putman, Oklahoma...In 1906 David LAY returned to LaFollette, Tennessee . Before David left for Tennessee he was working for Sam Parks in Roger Mill Co. Oklahoma. While in LaFollette, Tn., David LAY visited a saloon one evening late and had trouble with one Harry JONES, a local bad man who had shot and killed an engineer and also had knifed the eye out of a Dick WILLIAMS. This JONES was abusing the brother-in-law of David LAY (Homer COKER). David LAY took up the fight for his brother-in-law. In the fight that followed, JONES had three broken ribs by a blow with a short stick of wood and was knocked out and the other piece of wood was stuck in his mouth. A Negro was standing by and interferred and got his hat knocked off by a piece of bone thrown by David LAY...The next day David went back to town, where the fight occurred, and was not arrested as the town authorities had discovered what kind of a bully JONES was. In 1908 David LAY returned to Roger Mill Co. Ok. and leased land from Maude HOWARD. He then later moved to the HUFF Ranch....In 1910 over some trouble with Phillip SOLLARS, who was shot by David LAY in a free-for-all gunfight in David's home corral, David made bond and went again to Tennessee until the effects of the shooting cooled down. ...and after two years in court, the case against David was dismissed by the court without fine or sentence. A few years later, Lacy BRIGHT killed four hogs for David LAY by running over them with a car...Lacy BRIGHT was knocked down and hurt by a hit on the head with David LAY's rifle barrel...Two charges were filed against David, one later dismissed. A five dollar fine and cost was leveled against David in the other one...On another day a woman came to the LAY home peeved about the cows getting in the field of feed...In the fight that followed, she was knocked out of the corral. She filed suit for damages - no suit action was taken. In a visit with Jim MARSHALL, over the same cattle deal, (Elisha LAY) was trapping on the creek and his traps were stolen by Luther TEAKLE. A reward of fifty dollars was offered by Elisha LAY for the recovery of the traps. David LAY went up to TEAKLE's home and found TEAKLE out by the barn. He denied taking the traps. David found the traps buried in the cotton patch. TEAKLE apologized for taking them. ...David LAY had many similar experiences in the early days in Oklahoma. He survived when other less hardy settlers were run out by ruffians...His house and all contents were burned on January 3, 1960. By Gilbert LAY
