General Notes for Child Norman Doctor Lay

Ancestry.com lists Lucretia Dacus as a spouse, but Ida Cornelia Anderson was married to him prior to a marriage to Lucretia. (1880 census, as well as family records, indicate that.) The concensus of the databases on Ancestry.com state his birth date to be 16 Sep. 1853. Also, he is the son of Jesse Lay and Mrya Nicholson. Jesse Lay is the son of James Lay and Elizabeth McKinney. James Lay is the son of Charles Middleton Lay and Nancy Freeman.

BIO: Per Mr. Heinle, "Jack" LAY was originally buried in the Lay Cemetery near his farm in Campbell Co., TN.; later, his remains were re-interred by the TVA at Baker's Forge Memorial Cemetery, also in Campbell Co. Mrs. McCARTY related the traditional story of the arrival and settling of the LAY families from ENGLAND. "According to Mary Alice ERNHART, grand daughter of Wm. Quillin LAY, son of John Jack LAY and Mary Pauline...the LAYs -- three LAY brothers -- John, Jessee (and) David --came from ENGLAND arrived in the Land of Charles in Southern Carolinas. There John David LAY, son of Jessee and father of John "Jack" was born. John, Jessee and David moved into VA near Gate City & farmed the John Lay Homestead. From there Jesse & two sons, Jesse Jr. and John David moved down to Elizabethton, TN. From there they moved down to Claiborne, Co. TN (later where they lived became Campbell Co., TN)... The farm was located on both sides of the Powell River in what is now Campbell Co...about 6 miles from LaFollette, TN. ..."Jack" and Mary Pauline "Polly" ran the Lay gristmill on the Powell River....the Lay's used a ferry to get from (one) side of the Powell river to the other side of the farm....the Dave Lay Cave that was on the farm. Tradition says "Jack" hid Civil War Soldiers in it. Also he hid gold in it. Family says Jack's son David found the gold and that is how he bought the heirs out... John Jack is buried beside his mother... ...It is said old Jesse Sr. was an old man when he came to Claiborne Co TN. & died not too many years after coming to Big Valley. Jesse Jr. & John David took over the farm --Then John Jack & his son David."

In notes on her family group sheets, Mrs. McCARTY wrote, "...During the Civil War John Lay's sympathies were with the Union Cause. Although he had two sons that served in the Union Army, his oldest son, Bartlett, joined the Confederate side..." May, 1997: Compiler established contact with Steve STAMM, a descendent of the LAYs via their son, David L. Steve provided a copy of a page from a marriage index which lists John and "Catharine ODEL" LAY's marriage as 1840; no specific date is given and no county is mentioned. The only possible documentation of this marriage compiler has found was in a Claiborne County index which listed this same marriage and the "1840" date. BIO: Contact via "The Genealogical Helper Magazine," between Bill HEINLE and compiler resulted in most of the initial information compiler was able to find about the children of Bartlett H. and Elizabeth (QUILLEN) O'DELL. Later research in Claiborne County, TN brought the three Lawrence EDWARDS' books about the Old Speedwell community to light. This is apparently where much of Mr. Heinle's data came from, too. Compiler was unable to find specific documentation for the marriage of John "Jack" LAY and "Polly" ODELL in Claiborne Co. For a while compiler was tempted to believe the marriage took place outside of Claiborne County, and it may have; however, Mary Pauline's parents were living in Claiborne County from 1840 until they died. Direct descendents of the LAYs, Bill HEINLE and Eva McCARTY, record Mary P. and "Jack" LAY's marriage in 1839 in Claiborne County, TN. "Jack" and Mary P. LAY were enumerated in Claiborne County in 1850. By 1860 they were in the Fincastle P.O. area in Campbell County when the enumeration was done. In 1870, Mary P. is enumerated "next door" to her daughter and son-in-law, Elizabeth and James "CURNUTT", in Campbell County. "Jack" LAY died in 1862, and Mary P. was shown as the head of her own household in 1870. Her three youngest daughters were still at home. March, 1996: Compiler received a back issue of "Reflections", a quarterly newsletter of the Claiborne County Historical Society which contained a feature article on the ODELS, compiled by Marjorie WALSH, a descendent of Marshall L., Mary Pauline's brother. Per the family group sheet for Bartlett and Elizabeth shown in the article, "Polly" ODEL's name is given as "Mary Margaret 'Polly' ODELL". The source of this data is not specified, but may have come from papers Ms. WALSH found at the LDS Library in Salt Lake City. Nov. 1996: Compiler established contact with Eva McCARTY of Clinton, TN, via correspondence with Marjorie WALSH. Mrs. McCARTY, a desc. of Mary P. O'DELL LAY, has provided detailed information on the LAY family. Since establishing contact with other descendents of the Bartlett O'DELL family, several very specific dates have been found on various members of Bartlett's family. Once specific birth and death dates began to appear from tombstones, death records, etc., other conflicts in previously recorded data resulted. One instance of this was the "ca" year of birth given to Mary P. (O'DELL) LAY. Her year of birth had been calculated as "1824" until the discovery of Louisa/Eliza (O'DELL) NELSON's tombstone. That stone records Louisa/Eliza's date of birth as 11 April 1824. Compiler re-examined her files to find evidence to support the "1824" date of birth for Mary P.. The three census records available show her as being 26 in 1850, 39 in 1860 and 50 in 1870. This type of variation in age increments from one census to another have been common in the records for the O'DELL family and their close kin. In NOV, 1996, compiler received one of several letters from Eva McCARTY. Mrs. McCARTY wrote, "...I found in the records of Marion County, TN, the Sardis Methodist Church Cemetery...Mary Pauline <Polly> O'DELL LAY's tombstone says, ' Mary "A." 1818-1895 Wife of John LAY'..." This is the first specific year of birth compiler has found for this ancestor. The only documentation found to date that may be that of the marriage of Jack and Mary Pauline LAY comes from two marriage indexes -- one in Claiborne County, TN (found by compiler) and a photocopy provided by Steve Stamm, which is probably from a TN state index. Both sources show, "LAY, John (to) Catharine ODLE; 1840; Book 2; page 2." Mrs. McCARTY reports that she found the date of the LAYs marriage in the work of Mary Pauline's great grand daughter, Mary Alice (LAY) EARNHART, a family historian with many years of work on the LAY family.

BIO: In a letter to Marjorie WALSH, Coconut Creek, FL, Sept. 1996, Eva McCARTY, another descendent of Bartlett O'DELL, listed the children of Mary Pauline (O'DELL) and "Jack" LAY. Concerning Bartlett LAY, Ms. McCARTY reported that he died in the Civil War at a place called "Fishing Creek". Per Eva McCARTY, in her notes on her LAY ancestors: "During the Civil War John LAY's sympathies were with the Union Cause. Although he had two sons that served in the Union Army, his oldest son, Bartlett, joined the Confederate Army. The following is from David Richard LAY, son of Elisha LAY: 'Bartlett was in the Battle of Fishing Creek in Tennessee near the Cumberland Gap. He was wounded in the leg by a cannonball. The story goes that during the battle, one of Bartlett's brothers came upon him. Bartlett asked for a drink and the brother went to a nearby creek and brought him some water. The brother, who is thought to be David, told David R. LAY, that it was one of the hardest things he ever had to do, was to leave Bartlett. He never saw him again.'" Bartlett's age was given as "10" on the 1850 census for Claiborne County. By census enumeration time, 05 July 1860, the land on which the LAY farm was located had become part of Campbell County, TN. Bartlett, who would by then have been about 20 years of age, was not enumerated with Jack and Polly's household. Compiler checked other "LAY" households to see if he might have been working for a relative or simply visiting in one of the relative's homes on that date, but he was not located. Although the War did not actually begin until April, 1861, seven states had seceded from the Union by the time of President LINCOLN's inauguration in March. It is possible that Bartlett had already made known his difference in sympathies from his father's, and that he had left the home because of these conflicts. In May, 1997, compiler established contact with Steve STAMM, another descendent of the "Jack" LAY family. In an E-mail message to compiler, Mr. STAMM wrote, "...The battle was known by three different names at the time. The Confederates called it 'Fishing Creek,' the Union called it 'Logan's Crossroads' and 'Mill Springs'. The battle was fought on 19 Jan. 1862 near the modern day town of Nancy, Kentucky. After the battle, which was a devastating defeat for the C.S.A., all the dead were buried in a mass grave in a field...Just today, 26 May 1997, the VA dedicated a cemetery on the battlefield with markers for each of the C.S.A. soldiers killed in action. Martin B. LAY's (a.k.a. Bartlett LAY) name is among those. I have pictures of his headstone. I also have his service record. He was in the 15th Tennessee Inf. Company B..." On page 408 of the Military Annals of Tennessee, Regimental Histories and Memorial Rolls, under the heading "Company B", the name heading the right hand column reads, "LAY, B.M., k. at Fishing Creek." BIO: Concerning Lavisa LAY, the daughter of Mary P. and "Jack", Eva McCARTY wrote the following: "Lavisa was the second child of John "Jack" and Mary Pauline O'DELL LAY. She was married to James BROWN on Aug. 9, 1858 in Campbell Co., TN. She and her husband had to leave Tennessee and they went to California. Then on to the Verde Valley of Arizona. They had one daughter named Sarah. Sarah married a man named Davis and they adopted a daughter named Ella Davis. Sarah died at an early age and James and Lavisa took Ella and raised her. Ella married Joe LAY's brother, Jame Robert LAY, who was called "Doc". Lavisa is buried in the Cottonwood Cemetery, Cottonwood, AZ next to her brother Elijah and his wife. Her husband killed or thought he killed a man in Tennessee and they left so he would not have to stand trial. Apparently, he was a wealthy man." Per the 1850 census, "Lavicy" was 8 years of age; in 1860, she was already married and away from the LAY household. After proofreading compiler's transcription on this individual, Mrs. McCARTY corrected the date of this marriage to "8/9/1858." (Compiler had recorded "09/20 ?") BIO: Mr. HEINLE reports that Elizabeth LAY was born in 1841; however her age on the 1850 census was given as "6." Eva McCARTY gives 1843 as the birthdate for Elizabeth, and the 1870 census (enumerated 14 July) gives her age as 26. Mr. HEINLE had given Elizabeth's spouse as "James H. CURNUTT." This is the spelling used for the 1870 census record, too. Researching 1860 census for Campbell County, TN on microfilm, Jan., 1997, compiler located the household of "David CORNUTT", 50, farmer, born in TN. Along with his wife, Drucilla, there are five others enumerated in this household. Among them is 18-year-old James H."CORNUTT". This family resided in the area of the Fincastle, TN post office, three households before that of John and Mary (O'DELL) LAY. In the LAY household, there is a 16-year-old Elizabeth. It is likely David and Drucilla CURNUTT are the parents of Elizabeth's husband, James H. CURNUTT. The 1870 census for Campbell Co., TN shows James and Elizabeth living next door to Elizabeth's mother, Mary Pauline (O'DELL) LAY. Enumerated in their household were James, 3; Kate, 2 and Mary "2/12." Per the 1880 census, the CURNUTTs are 38 and 37 years old respectively; there are seven children in the household ranging in age from seven months (Sarah H.) to 13 years (James M.) Concerning Elizabeth, Eva McCARTY writes as follows: "ELIZABETH, was the third child. She was born in 1843. She married a man by the name of James H. CURNUTT, on July 7, 1862 in Campbell Co. TN. They moved to Globe, AZ. They also lived in Livingston, AZ where James was Postmaster Sept. 17, 1896-Mar. 7, 1905 ...Elizabeth and James had eight children...Elizabeth and James are buried in Globe Cemetery, Globe, AZ."

Union Army, Company F, 6th Tennessee Vol. Infantry

BIO: The following is an excerpt from one of Eva McCARTY's letters to compiler:

"David was one of the sons who fought on the Union side during the Civil War. He enlisted at Boston, KY on the 10th of March 1862, as a private in Company F, 6th Tennessee Vol. Infantry. He was described as 5 ft. 8 inches; complexion fair; dark eyes; black hair, and occupation, farmer. He was detailed to the Pioneer Brigade, 3rd Battalion, Army of the Cumberland. National Archives records show he fought in the Battle of Chattanooga, Atasona, Murfreesboro and was with Sherman on his march to the sea. During his enlistment, he came down with malaria and was honorably discharged at Nashville, TN on the 24th day of March 1865. On the LAY property was a cave which became known as the "Dave LAY Cave" because he hid his troops in it during the war. Also, the family hid their valuables in it. My mother said she had been back into it for about a mile and it was very cold. On a 1900 census report, David had 900 acres of land in Campbell County, TN. The year is unknown, but David and Elizabeth moved to Oklahoma and then to Baca County, Colorado. It is said that Elizabeth was blind at the time of David's death. He had asked to be laid out under a big tree in the front yard and when they brought Elizabeth out for the funeral, she looked down at the casket and said, 'doesn't he look pretty?'"

May, 1997: Compiler established contact with Steve STAMM, a descendent of David L. and Annis Elizabeth "Lizzie" LAY. Mr. STAMM contributed more information on this couple in an e-mail message on 25 MAY -- "David LAY was buried in the Lay's Chapel cemetery. Later all the graves in the cemetery were moved to the Springfield Cemetery by Nancy Taylor (LAY) PARKER the daughter of David and Annis LAY. In the Lay's Chapel Cemetery there was a white marker that stood by the grave marking it as the grave of a Civil War veteran. We think that this marker was pushed into the open grave after the exhumation of David LAY's remains because it is not currently standing in the Springfield cemetery..." Concerning the occupation of David LAY, Mr. STAMM writes, "...He was also a veterinarian and mill operator. I have a copy of one of his veterinarian's log books. This book seemed to have been used mainly to keep notes about trips and other day to day events. Just before he moved to COLORADO, he was operating a mill. It was just below "Dave Lay Cave." My grandfather, Merl O. PARKER said that the water that ran out of that cave was very cold. He said that they used to keep much of their perishable food there. I think that I have identifed the mill as the "Blind Graves" mill that was still standing when TVA flooded the whole place in the 1930s..." To compiler's comment above that "the year is unknown, but David and Elizabeth moved to OKLAHOMA and then to Baca County, COLORADO," Mr. STAMM responds with, "The year is now known! I'll transcribe a note written by Annis Elizabeth LAY in 1915 which details their move to COLORADO from TENNESSEE." (See Annis Elizabeth TAYLOR biography, computer #1100.)

BIO: Eva McCARTY included the following in a letter to compiler in 1996:

"William Q., 'Uncle Billy'...and Louisa are both buried in Sardis Methodist Cemetery where they have a huge monument..."

In June, 1997, Mrs. McCARTY sent a photocopy of an article re William Quillin and his family, written by a descendent of William's son, George Calvin LAY. In this article, Mrs. EARNHART writes --

William Quillin Lay was born near Tazewell, Claiborne County, TN. on May 7, 1847. The son of John Lay and Mary Pauline O'Dell Lay, was one of a family of ten children. On the 14th day of December 1873 he was united in marriage to Louisa Jane Brown in Marion County, Tennessee. Louisa Jane Brown was the daughter of George Washington Brown and America Alder Brown...

In 1867 William Quillin Lay went to Indiana near Lebanon and later to Stanton. During this time he devoted his energy to farming, and the timber business, later he occupied the position of weigher in a mine. In 1870 he took up his residence in Campbell County, Tn. and a year later, 1871, came to Marion County. For eleven years he engaged in farming near Victoria and then he purchased very desirable property at Rankin's Cove, about five miles east of Jasper. William Quillin Lay was educated in the common schools, was always a busy and a useful man. William Quillin Lay and wife Louisa Jane Brown Lay were the parents of ten children...

..., William Quillin Lay, built a log school house on the hill a mile from their home, where three roads joined...

William Quillin and Louisa Jane Brown Lay also had thirty-four grandchildren.

COMPILER's NOTE: Compiler found a list of the men who served with the 2nd TN Vol. Inf. Reg. on a computer internet genealogy site, Sep. 1997. On that list appeared a "William P. LAY". Information given was as follows: LAY, William P: Private; H; Unk; 00; 1 Aug 1863 - 2 Mar 1864. Unk. Discharge certificate furnished by War Department 28 Apr 1891. Details of separation not clear. Unfortunately, the "00" is in the position of "Age of the soldier". There is no way to confirm whether or not this might be William Q.'s record. Compiler has no information from descendants of William Q. that he was a veteran of the Civil War. BIO: Elijah is the direct-line ancestor of William J. Heinle who has provided much of the data for the Jack LAY and Mary Pauline (O'DELL) LAY families. Elijah was a twin to Elisha LAY. A photo sent by Mr. HEINLE, shows both twins in Civil War uniforms. Elijah and his twin, Elisha, as young boys, are said to have served as messenger boys for the Union Army during the Civil War. Steve STAMM, another descendent of the LAY family located via the computer genealogy network, has as part of his LAY home page, a list of "LAYS WHO WENT TO WAR." Per that list, Elisha LAY was a private in the "154th TN Inf., Co. B. Senior Reg.'s" Elijah is not included in this list. Elijah and his wife, Mary PETREE, had ten children, but only six lived to adulthood. Per Eva McCARTY, "Mary explained that Tennessee was a hard place to raise children because there was so much fever..." Mrs. McCARTY goes on to tell of Elijah's migrations from Campbell County TN to Marion County, and later to ARIZONA. "Sometime in the late 1870's or early 1880's, Elijah built two barges and loaded his family and all their possessions... They made their way down the Powell River into the Clinch River to the Tennessee River and then on to Rankin's Cove where his brother, William Quillen, had a farm. Elijah was was to work for William...in the 1880s, Elijah's son, Dave left Rankin's Cove and went to AZ where Elijah's brother, "Johnny" and his wife,...'Aunt Mack'... and daughter, Jennie...settled on the lower Verde River...Elijah was never satisfied in TN after Dave left home. As soon as he could, he gathered his 1rops and sold his home ... the next year, he and his wife and five children embarked on what was called an immigrant train from Jasper, TN... They arrived in Prescott, AZ on March 22, 1892. They still had two more days of hard travel before reaching the Verde Valley where Dave had located. When they arrived, the military at Camp Verde was having trouble with the Indians. They found land to rent, but the Army would not allow them to live in their tents as they had planned, so they lived in part of the adobe building that is now the Fort Verde Museum. Elijah homesteaded in Oak Creek Canyon near present day Sedona. The family finally settled in Cornville on lower Oak Creek. He farmed and ranched with his son, Joe, until his death. Mrs. McCARTY has provided a photocopy of the obituary for Elijah LAY; the article is accompanied by copies of photographs of Elijah and Mary Ann. A copy of this page is included in this genealogy.

BIO: U.S. Census for 1850 lists the twins as "Eliza,(F) and Elijah(M)." Per Mrs. McCARTY, the twins looked so much alike that most people could only tell them apart when they were standing together; Elisha was the shorter of the two. A picture sent to compiler by Wm. HEINLE showed these two very young men in what appeared to be Union Army Uniforms. Mrs. McCARTY explained several years later, that the boys were too young to participate in the actual fighting in the Civil War, but both served as messengers for the Federal troops. Per Ms. McCARTY, Elisha LAY died at Oklahome City, at the home of his daughter, Izora. Elisha and his first wife, "Liza" SWEAT, were both very young when they married, sometime in 1867. Their first child, born in 1868 died at birth; scarcely two years later, the second child, Mary, was born. Elisha LAY was working in INDIANA with his brother, William Quillen Lay, in the lumber business when his son, William, was born. Shortly after the birth of William, Eliza was diagnosed with TB. They immediately moved back to TENNESSEE where she died, leaving a 3 month-old son. Elisha, with three small children, met and married Martha WILLIAMSON soon after Eliza's death. Lavisa, the third of the couple's children, and little William referred to Martha as their mother. Elisha was never satisfied in one place. They lived several places in Campbell County, a while in Sequatchie Valley, TN, and back to Campbell County. In 1897, he, Martha and daughter Lavisa with her husband, Jesse Jackson ELDER left TN by train for Oklahoma. They got off the train at Weatherford, OK. Lavisa and Jackson ELDER stopped at Yukon, OK, then later moved to El Reno, where they settled down. Elisha and Martha traveled from Weatherford to Dewey County, OK by wagon. They settled on land located about 3 miles east and 2-3 miles north of Putman, OK. Mrs. McCARTY writes:

"They lived in a dugout that leaked when it rained and the snakes could crawl in. Here they lived through drought and blizzards so bad they nearly froze to death. Cattlement didn't like the Sodbusters and weren't the easiest people to neighbors along side.. They went hungry many times. Lots of quail, squirrel and rabbits ended up on their table. 'Guess that's why Elisha and his son Richard became expert marksmen. They hunted with a muzzle loaded gun when a miss meant no food. The Lays farmed and raised a few cattle, but Elisha was a carpenter and built homes in the area. Sometimes pay was vegetables, meat or a little cash. Sometimes he walked 10 to 12 miles to work. He was a faithful Mason and walked many miles to lodge meetings at night. Martha was an Eastern Star member. Martha passed away in the early 1900's...After her death the family separated -- some to return to Tennessee and others to remain in Oklahoma... Elisha spent the rest of his life traveling to Tennessee, California and Oklahoma to visit and live with his children. He never unpacked his trunk. ...He had no religion. He did not believe in God... Elisha Lay and his son-in-law Jesse Jackson Elder built a beautiful house on the John "Jack" Lay farm in Campbell County, TN on the Powell River. This is where Jesse met Lavisa Lay. After Jesse and Lavisa returned to Tennessee from Oklahoma, they lived in this home until his death. Lavisa stayed there until the TVA bought the land." Eunice (LAY) PLUMMER's autobiography contained the following remarks about her grandfather, Elisha LAY -- "As a small girl I had bad ear aches. My grandfather Lay would get up during the night and light his old pipe and blow smoke in my ears. He was about 81 years old at this time. Then there was the skunk oil that was used on baby sister (Violet) when she had the croup. These were some old time remedies used by Grandfather LAY that really did work..."

BIO: William J. HEINLE provided the first data on the Mary Pauline (O'DELL) and "Jack" LAY family in TN. Per Mr. HEINLE's family group sheets, this son of the couple was named "John David". His brother was called "David" LAY. In data sent to compiler in 1996 by Eva McCARTY, there was no middle name or initial provided for "John", however, Ms. McCARTY did add "Johnny" to the name--apparently used as a nickname. Examining the 1860 census for Campbell Co., TN, compiler was unable to decipher the name of this male child in the LAY household. There appeared to be a "D" at the beginning, but this also could have been a capital "J." The name appeared to end with "y"; compiler recorded "Douny?/Donny?/Drury?". The age of this child would calculate to about 1851; later examination of the LAY's family group indicated that "John" was born closest to this date. The name which was unreadable on the microfilm may have been "Jonny",but compiler has elected to record this child's name as "John D." until further confirmation of his middle name is located. The household just preceding the LAYs' on the 1860 census, was that of "S.W. and Elizabeth BROWN." Compiler did not list the children in this household, but these may have been the parents of America BROWN, later the wife of "Johnny" LAY. Per Ms. McCARTY, John D. LAY, II died in Brown Springs, AZ, and is buried near Sedona, AZ. In her biographical information on this family, she writes, "...His first wife was America BROWN (Aunt Mack). They had one child, Jennie, who died in Prescott, AZ in her early twenties. His second wife was Jesse FENSTERMAKER DUNCAN, Johnny and America are both buried at the Schuerman Ranch near Sedonna, AZ." Compiler was unable to find this couple on the 1880 census in Campbell or Union Counties in TN. This may indicate that they had already migrated to ARIZONA by June, 1880.

BIO: In biographical information about this family, Eva McCARTY writes, "Mary was terribly humpbacked. When she was a baby the twins, Elisha and Elijah were fighting over her and dropped her over the back of a chair. Her back was apparently broken or damaged in a way that left her deformed. She was living with her sister, Rhoda and her husband, Charles Wells. Mary became pregnant by Charles and had a baby. Both she and the baby died. They are buried in the Old Lay cemetery in Campbell Co., TN. They were not removed by the TVA as there was no marker on her grave. (Old Lay Cemetery is not under water)."

BIO: Although neither Mr. HEINLE nor Mrs. McCARTY gives a middle name for Rhoda, one of them recorded her name as "Rhoda C." On the 1870 census, Rhoda appears as "Kate" in her mother's household. She was enumerated as "Roda C." in her husband's household in 1880. It seems likely that her middle name may have been Catherine. Mrs. McCarty writes, "Rhoda is the tenth child of John Jack and Mary Pauline...She married Charles Henderson WELLS ...After the scandle about her sister, Mary, Rhoda and Charles left Campbell Co., and apparently no one knew where they went...Through a desc. of Charles WELLS, ...that Rhoda and Charles moved to Fountain City, (Knox County TN). They are both buried in the Salem Church Cemetery...After Rhoda's death Charles married Lizzie WHITE." BIO: Per William HEINLE, "Big Valley Dave" LAY was born in NORTH CAROLINA; two examinations of the 1850 census clearly marked the place of birth recorded there as "S.C." Compiler has used the SC until further evidence is found. On the 1850 census, there is a "Jessee LAY" household recorded on the 1850 census in the same 7th Subdivision. His age is given as "52" and his place of birth as TN. His wife, Sarah, was born in VA. Compiler questions whether this might be another son of "Big Valley Dave." Compiler found a "David LAY" in Claiborne County, TN on the 1830 census. There was a male between the ages of 60 and 70, a male 15-20 (probably "Jack" LAY, husband of Mary Pauline O'DELL); two females aged 60-70 and one 15-20 are also shown on this film. Compiler feels this is probably "Big Valley Dave" LAY's household. On the preceding page of this film there is a Lewis and a Thomas LAY. Thomas is the same age range as "David"; Lewis is 30-40. Three pages after David LAY there is a Jesse LAY, 20-30.

BIO: Per Mr. Heinle, "Jack" LAY was originally buried in the Lay Cemetery near his farm in Campbell Co., TN.; later, his remains were re-interred by the TVA at Baker's Forge Memorial Cemetery, also in Campbell Co. Mrs. McCARTY related the traditional story of the arrival and settling of the LAY families from ENGLAND. "According to Mary Alice ERNHART, grand daughter of Wm. Quillin LAY, son of John Jack LAY and Mary Pauline...the LAYs -- three LAY brothers -- John, Jessee (and) David --came from ENGLAND arrived in the Land of Charles in Southern Carolinas. There John David LAY, son of Jessee and father of John "Jack" was born. John, Jessee and David moved into VA near Gate City & farmed the John Lay Homestead. From there Jesse & two sons, Jesse Jr. and John David moved down to Elizabethton, TN. From there they moved down to Claiborne, Co. TN (later where they lived became Campbell Co., TN)... The farm was located on both sides of the Powell River in what is now Campbell Co...about 6 miles from LaFollette, TN. ..."Jack" and Mary Pauline "Polly" ran the Lay gristmill on the Powell River....the Lay's used a ferry to get from (one) side of the Powell river to the other side of the farm....the Dave Lay Cave that was on the farm. Tradition says "Jack" hid Civil War Soldiers in it. Also he hid gold in it. Family says Jack's son David found the gold and that is how he bought the heirs out... John Jack is buried beside his mother... ...It is said old Jesse Sr. was an old man when he came to Claiborne Co TN. & died not too many years after coming to Big Valley. Jesse Jr. & John David took over the farm --Then John Jack & his son David."

In notes on her family group sheets, Mrs. McCARTY wrote, "...During the Civil War John Lay's sympathies were with the Union Cause. Although he had two sons that served in the Union Army, his oldest son, Bartlett, joined the Confederate side..." May, 1997: Compiler established contact with Steve STAMM, a descendent of the LAYs via their son, David L. Steve provided a copy of a page from a marriage index which lists John and "Catharine ODEL" LAY's marriage as 1840; no specific date is given and no county is mentioned. The only possible documentation of this marriage compiler has found was in a Claiborne County index which listed this same marriage and the "1840" date. He attended University of Tennessee at Knoxville. He then went to Washington, D.C. where he obtained employment. After working in D.C. for a few years, he went to New York City and worked. While living there, he was inducted into military service during WW II. Mary Alice writes, "David was inducted into the Army March 1942 in Railway Guns Division. He served his country well in ENGLAND, FRANCE, BELGIUM, GERMANY and almost to RUSSIA and then back to the UNITED STATES, during those war torn years and was honorably discharged on Nov. 11, 1945, at Camp Atterbury, Ind. After a visit in the home of his parents and other members of the family, relatives and friends, John David returned to his former job with the H.S. Kress Co. in New York City. He was soon transferred to one of their stores in Rockford, and went back to Washington, D.C. where his two youngest sisters were. He shortly found employment in that city and still lives and (is) employed, at this writing, 1965, John David is working for the Sears Roebuck Company, and owns his home where he lives at 800 Adrian St. S.E., Washington, D.C."
