Greenville's Unionist Voice By A.V. Huff, Jr. Among the giants of South Carolina politics in the mid-nine teenth century, one of the most imposing was Benjamin Frank lin Perry of Greenville. He shares with James L. Petigru o f Charleston the personification of the Unionist movement i n a state increasingly determined to divide the country an d create a Southern nation.
Born in 1805 in what is now Oconee County, Perry enrol led in 1823 in the Greenville Male Academy and remained i n Greenville the rest of his life. He read law in the offic e of Baylis J. Earle, and in 1826 he entered the politica l fray over nullification. In a series of letters in the lo cal newspaper he signed "Junius," Perry espoused the union ist views of the majority of Greenville District citizens a nd attacked the doctrine of states rights that affirmed th e power of a state to nullify a federal law. Opening a la w office in 1827, Perry became one of the most successful a ttorneys in the region.
At the same time, he launched his long public career b y becoming editor of the Greenville Mountaineer in 1829. Th rough his forceful editorials, Perry became one of the best-known unionist voices in Sout h Carolina. Feelings ran so high in Greenville over nullifi cation that Ferry became involved in a series of brawls an d eventually a duel with Turner Bynum, editor of the pro-nu llifier Southern Sentinel. The duel occurred on August 16 , 1832, on an island in the Tugaloo River. Perry wounded hi s opponent fatally, and Bynum was buried at the Old Stone C hurch, near Pendleton, close to the site of the duel. Accor ding to tradition, Bynum was buried at night in the midst o f a storm, and his grave was marked by the poles of the str etcher on which he was being carried. The poles took root a nd grew into tree shaded Bynum's grave. Statewide, nullific ation triumphed, and the South Carolina convention formall y nullified the federal Tariff of 1828 in November 1832. Pe rry and the other unionist delegates to the convention defi antly refused to sign the Ordinance of Nullification.
When the passage of a compromise tariff in 1833 enable d the South Carolina convention to repeal its nullificatio n ordinance, Perry was overjoyed. But he did not overlook t he role that John C. Calhoun had played in fomenting civi l discord. Like many of his fellow Greenvillians, he deplored Calhoun' s actions, and wrote in the February 16, 1833 Greenville Mo untaineer: "Mr. Calhoun has ... shown a great want of Senat orial dignity and propriety. His conduct has been that o f a rash, inexperienced young man. He has spoken with a war mth and passion which do no credit to his wisdom. He has ha d very little regard for the rules and order of that body i n which it was once his duty to keep order [as Vice Preside nt]. Once the specter of nullification was over, Perry resigne d as editor of the Mountaineer. After an unsuccessful rac e for Congress in 1834, he was elected to the state legisla ture in 1836, where he remained through 1865 with the excep tion of three terms when he chose not to serve.
In his private life, in the fall of 1836 Benjamin Perr y met and fell in love with Elizabeth Frances McCall of Cha rleston, the niece of Sen. Robert Y. Hayne. They married i n April 1837 and soon occupied a handsome town house on Mai n Street in Greenville. Their marriage was a perfect matc h and lasted until his death in 1886. In the 1840s Ferry be came a farmer as well as an attorney; he purchased 200 acre s of farm land and eventually owned twelve slaves.
Perry did not neglect the cultural and religious dimen sions of life. He became the center of a vibrant literary c ircle which included James L. Petigru, John Belton O'Neill , William Gilmore Simms, and, perhaps his closest friend, J oel Roberts Poinsett. He was reputed to own the largest lib rary -- some 5,000 volumes - in the upcountry. Until his ma rriage, Perry attended the Baptist church of his youth, alt hough, as he once wrote, he preferred the "more liberal an d more rational" Methodists. Elizabeth Perry was a devout E piscopalian, and he attended Christ Church with her, but wa s never confirmed. In his autobiography he wrote, "I thin k true religion consists in doing good to others & living v irtuously ourselves ... relieving the distressed, assisting the poor , instructing the ignorant, correcting the vicious, etc.
Politics was never far from his mind. By the 1840s Fer ry, ever the staunch Democrat, grew in his praise of Calhou n's defense of the extension of slavery in the west. But Ferry opposed the senator's failur e to support the Compromise of 1850. At Calhoun's death h e wrote: "I regard his death as fortunate for the countr y & his own fame. The Slavery question will now be settled . He would have been an obstacle in the way. His course ha s always been in the extreme.
In the secession crisis of 1851 Ferry, though Benjami n Franklin Perry, still a unionist, supported the cooperationists who stoppe d the secession of South Carolina as a single state. Bu t a decade later majority sentiment had changed dramatically, even in Greenville District. When Fer ry refused to walk out of the National Democratic Conventio n in Charleston with the majority of the state delegation i n May 1860, he was booed from the gallery. When the secessi onists carried Greenville in October, Perry remarked to Jam es L. Petigru that "I have been trying for the last thirt y years to save the State from the horrors of disunion. The y are now all going to the devil, and I will go with them."
Once the Civil War came, Ben Perry urged his son, alon g with other citizens, to volunteer for the army. He becam e a Confederate district attorney and continued to serve i n the state legislature. In 1865 he was appointed a Confede rate district judge. When the war ended, however, he becam e an instrument of reunion. President Andrew Johnson appoin ted Perry provisional governor in 1865 to restore a civil g overnment to the state. A convention was elected to writ e a new state constitution, and he espoused reform of the a ntebellum system by which the planters dominated the low co untry parishes. In one important particular he did not change: "This is a whit e man's government and intended for white men only." Perr y supported the disfranchisement of the freemen and the enactment of a Black Code to regulate the l ives of African Americans. He infuriated radical sentimen t in the North, and in November 1865, he gladly turned hi s office over to his successor. Perry was elected to a sea t in the U.S. Senate, but when Congress refused to seat him , he returned to Greenville. He urged whites to oppose th e radical reconstruction government and worked for the elec tion of Wade Hampton in 1876.
In 1871 Ben Perry and his family moved to Sans Souci , his estate north of Greenville. There he built a magnific ent Second Empire mansion and lived among his books. He wa s in great demand as a speaker and wrote a series of histor ical and biographical essays. When he died in 1886, he wa s eulogized throughout the state. Charleston's News and Cou rier saluted him as "statesman, jurist, and man of letter s and patriot, unflinching in his loyalty to these United S tates, and immovable in his devotion to the Commonwealth o f South Carolina... Governor Perry was in many respects wit hout peer in our public life, and in nothing that was worth y and of good report had he any superior."
