LAST WILL AND TESTAMENT OF JOSEOH STUART
In the name of the Benevolent Father of all; I, Joseph Stuart, make and publish this my last will and teatament.
1st. I direct that my body shall be decently buried and that all my honest debts shall be paid and then I will and devise the heirs of Sallie A. Young, one hundred dollars and the heirs of Elmina Melser, that is to Melser fifty dollars and to Duvinas Melser three hundred and fifty dollars and to heirs of Zephania Stuart one hundred dollars, to Moses S. Stuart, one hundred dollars, to Mary J. Custard, one hundred dollars, to George Stuart, one hundred dollars, and Eliza Vernon two hundred dollars, Dema A. Melser's heirs, seven hundred dollars.
2nd. And after the above is paid and the expenses of carrying out this will, I give and direct the balance of my estate whatever it may be shall be equally divided between my twelve children or their heirs. to wit: Moses S. Stuart, William Stuart, George Stuart, Eliza Wade, Martin Stuart, Joseph W. Stuart, John W. Stuart, Mary J. Custard, and the heirs of Sally Young, Alemina Melser and Dema Melser.
3rd. I do hereby nominate and appoint my son John W. Stuart ecucutor of this my last will and testament hereby authorizing and empiwering him to compromise, adjust, release and adjust in such manner as he may all the debts and clauses due me and also empower him if necessary to collect by suit or otherwise all debts that may be due or owing me. I do hereby revoke all former wills made by me.
In testament (of which) I have hereunto set my hand and seal this 7th day of July AD 1870.
