Sir Thomas Colepeper, who "pro bono servicio in part i b u s S cotie" received a pardon in the 32nd year of Edw a r d I . fo r breaking the park of the Prior of Christ Chu rc h , Can terbu ry, at Westwell, and the park of the Prio r o f M ichelh am, i n the 29th year of that King's reign , too k th e side o f th e Earl of Lancaster against Edwar d II. , and b eing Gove rno r of Winchelsea, was there exec uted i n 1321.
Previous to this, however, by a fine levied in 132 0 , p a r t of his estates, consisting of 2 messuages, 2 mi ll s, 4 0 5 a cres of land, 20 acres of meadow, 60 acres o f pa stur e , 80 a cres of wood and 20 shillings annual ren tal i n Pep yn gbery , Thonebregg and Teudele, were settle d on hi msel f an d Marge ry his wife for life, with remain der to t hei r son s Walter , John and Richard in successio n.
By Inquisition taken at Tunbridge 25th February, 1 E d w a r d III. (1327), it was found that Thomas Colepeper d i e d se iz ed of Bayhalle, with lands in Pepyngbery, Thone br eg g an d Te udele, and that Walter was his son and heir , a ge d 22 y ear s on the feast of the Purification of th e Ble sse d Virgi n Ma ry last past (2nd February, 1327). I n th e Inqu isitio n de te rris forisfactis, 17 Edward II. , take n at La mberhur st, ment ion is made of Thomas Colep eper' s estate i n Pepynb ery, incl uded in the fine levie d in 13 20, beside s which i t is state d that he had acqui red 50 a cres in ffo ghelesdenn e from Thom as Colepeper, s enr., i n 1310, 1 mess uage an d 1 carucate o f land in Ber nette an d Ramherste fro m Richar d Wych in 1320 , 1 messua ge and 6 0 acres of land i n Bocsted e from Ralph Ma rscot , 10 acre s in Bayrugge fro m Michael d e Bettesfield, a n d 40 acre s in ffernth (i.e. , Frant) fro m Roger de ffer rugge . It was not long, however, before all these estates w e r e r e stored to the family. By deed bearing date 1st Ju l y , 17 E dw ard II., Margery, widow of Thomas Colepeper , ag re ed to g ran t the Pepinbury estate to the King fo r the t er m of he r lif e on the payment of 12 marks per a nnum fro m t he Exche quer . But apparently she soon repent ed of thi s ba rgain, an d add ressed a petition to the Kin g prayin g tha t "le manoi r de l a Bayehalle" might be res tored t o her, t he grounds f or th e request being tllat t he King' s ministe rs had not on ly neg lected to pay the r ent, bu t had let he r houses go t o ruin , "a g'nt damag e de l'ava ntdite Marg'i e de xlli."
On this the King issued a commission to Henry de Cob h a m a n d others to investigate the matters set forth i n t h e peti ti on, and the direct result of this enquiry w a s a n order f o r the immediate restoration of all the, p ro pert y. The out ly ing estates were to be restored uncon dit ional ly, and i f lan ds had been "demised at ferm" th e far mers w ere to b e satisf ied for their expenditure o n the l and, wh ile wit h regard t o Bayhall and the land i nclude d in the f ine levi ed in 1320 , there was this savi ng clau se, viz., t hat thi s portion o f the property wa s to rever t to the Kin g in cas e all the pa rties mention ed in the f ine died with out issue.
From this order it appears that Thomas Colepeper acq u i r e d the Buxted property mentioned above in 7 Edward I I . , a n d in 13 Edward II. he purchased from Reginald, s o n o f Reg in ald Burgeys, of Boxstede, 1 messuage and 5 0 ac re s in Box ste de and Marsefeld. Note. In Daniel Maltby's will, 1731, there is no me n t i o n of Mary, b. 1703, Branford; nor of William, b. 17 0 5 , Br an ford; nor of John, b. 1722. It is evident tha t Ma r y lef t n o descendant or Daniel would have mentione d hi s g randch ild . Mary would have been 28 years old i n 1731 . De acon Ch arle s Foote in his MS. Genealogy of Ma ltby (p . 17 , Maltby- Moreh ouse Family) states, "Mary, (d au. of D aniel ) mar. --- - Good rich." This may well be t he case , as w e find: "Jul y 5, 173 0, Capt. Malbie's dee d from Go odrich . Land in Lit chfield f rom William Goodr ich of Cop ateneck , in ye provinc e of Mass . Daniel's son William evidently never married; and Dan i e l ' s son John would have been but nine years of age i n 1 73 1- -- hence must have died in his boyhood.

Daniel Maltbie/Maltby, son of William was a farmer b y o c c u pation. Wh en his father died, he left most of th e la n d a n d the farm to Daniel.
Daniel, like the rest of his family, was active in t h e C o n gregational Church of Branford - the same churc h hi s fa th e r helped found. He bec ame a Deacon of the c hurch.
After his father died, Daniel became the legal guar d i a n o f his younger brother John or Jonathon as he wa s la t e r know n.
Daniel was 18th on the list of Freeman of Branfo r d - t h i s was a mar k of community distinction and prom in ence.
According to family records, Daniel fought in the In d i a n W ars. In the inventory of his estate a sword is li s t e d - tes timony to his military service.
Daniel and Esther Moss were married at the Branford Co n g r e gational Ch urch on 27 October, 1702 by the Revera n d Sa mu e l Russell. Esther was als o from a prominent f am ily , he r f amily being old friends and fellow church m emb ers.
Daniel Maltbie is buried at the Old Burial Grounds a t B r a n ford. His grave is near his father and mother's . Hi s t om bs tone no longer stands due to vandalism.
In 1700, Daniel Maltbie joined the Church at Branfo r d . " E sther Moss , who was to become his wife, joine d t h e ch urc h at the same time. They were married Oct. 2 7, 1 70 2. (B ranf ord Record). She was the daughter of J o hn M os s (or M orse ) and Mary Lothrop.
John Moss was a son of John Moss, New Haven Planters A s s o c iation, June 4, 1639. Born in England, 1604. Mem b e r o f 1s t General Court, 1 639 and 1648, 1649 and 166 4 . C orpo ral , Aug. 6, 1642; May, 1678, Commissioner. H e w as on e o f th e first settlers of Wallingford, and d i ed i n 1707 , ag ed 10 3 years, according to records.
Mary Lothrop was dau. of Samuel Lothrop of New Lond o n , a n d wife Elizabeth Scudder. Samuel was a son of Re v . J oh n Lo throp who was bor n at Elton, East Riding o f Yo rksh ire , Eng land, in 1584. He was bred at Oxford , grad . Quee n' s Colleg e, 1605, and mar. Hannah Howse o f Eastwe l l, Co . K ent. Rev . In 1710, William Maltby left "to my son Daniel, al l t h a t h ouse and land where he now lives."

This half-brother of Daniel was then but twelve ye a r s o f a ge. He evidently remained Daniel's ward but a s ho r t tim e, f or, (p. 66 New Ha ven Rec.) we find: "Jonat ho n M aultbi e, Mi nor, child of Mr. William Maultb ie, la t e of B ranford , di d appear and made choice of Mr. Edwa r d Barke r of Branf ord t o be his guardian."

This is interesting as the first Allen Ball was o n e o f t h e first settlers of New haven. He is though t t o b e a bro th er of William Bal l of New Haven, consid ere d a s possibl y fa ther of Col. John Ball, whose dau. M ar y Bal l was mothe r o f George Washington. The "Tuttl e Gen ., p . 628," states : "T his would verify the traditi on, o r stat ement, that Joh n Bal l who mar. Mary Tuttle w as 2n d cousi n of Washington' s mothe r."

The tombstone of Daniel Maltbie was in the Old Buryi n g G r o und of Branford, not far from the stones of his f at her , W il liam, and stepmot her, Abigail. It was fairl y n ea r th e fen ce, and was sinking and in bad condition . Fo r t he Ma ltby F amily Association I had the stone st raight ene d and p roperl y cared for. Also, a cousin wen t to Bra nfo r d and p hotogra phed the tombstone. Unfortu nately th is w as stolen , and a g re at loss, as a frien d who in lat er ye ars went t o Branfor d to photograph i t , reported th e ston e no longe r existed . She wrote tha t apparently a s t ree t had been o ut throug h and land ev idently was neede d to m ake it suffic iently bro ad. Note. In Daniel Maltby's will, 1731, there is no me n t i o n of Mary, b. 1703, Branford; nor of William, b. 17 0 5 , Br an ford; nor of John, b. 17 22. It is evident tha t M ar y lef t n o descendant or Daniel would have menti on ed h i s grandc hild . Mary would have been 28 years old i n 173 1 . Deacon C harle s Foote in his MS. Genealogy of Ma ltby ( p . 17, Maltby -Moreh ouse Family) states, "Mary, (d au. o f Da niel) mar. -- -- Good rich." This may well be th e case , a s we find: "Jul y 5, 1730 , Capt. Daniel's son William evidently never married; and Dan i e l ' s son John would have been but nine years of age i n 1 73 1- -- hence must have die d in his boyhood.
