General Notes (Husband)
Henry had a brother William Scudder, living in 159 4 w h e n h e made his will. It has been assumed that thi s wa s t h e Will iam, yeoman, of Darenth, Kent, whose wil l date d Ju l y 27, 16 07, proved November 4, 1607, was abs tracte d by W at ers. In i t, William named , wife Margery , daughte rs Parn ell , Margaret , Joan, and Mary, all evid ently unde r 21; de ceas ed brother s John and Henry; broth er Henry' s sons Henr y, Th omas, and J ohn, and brother Jo hn's son H enry. One pa rcel o f land, Pric les Mead, was t o revert t o his decease d brothe r John's so n Henry if al l four daug hters died wit hout lawf ul issue . A piece o f land of tha t same name wa s among th e bequest s made b y the Rev. Henr y Scudder in 16 52, but a s records su gges t that at leas t three of William 's daughte rs married a n d had children , it is not clear ho w Pricles M ead woul d hav e come to He nry had the terms o f William 's w ill b een prope rly obser ved. William of Dare nth in his wil l a sked to be bu ried i n the churchyard at D arenth "as ne a r as may be unto m y f ather's grave."
Henry and William were probably the sons of a John Sc u d d e r who was dead by October 18, 1584, when his wido w Ma rg ar e t deeded property at Sutton at Hone and Horto n Kirb y t o h e r son Henry Scudder, carpenter; William Sc udder s igne d t h e "final concord" with her on "eighth da y of St . Mart in " 2 8 Eli. [19 Nov. 1585|. No will or bur ial reco rd ha s bee n fo und for this John Scudder, and h e has no t yet be en cle arl y identified among all the pos sible me n of tha t name i n th e group of parishes in whic h Scudder s were li ving. H e may w ell be the father burie d at Daren th.
2. Henry must have been only in middle age at the t i m e o f h is death, for most of his children were stil l i n th ei r mino rity. Calling himself "Henry Skudder o f Hort on Ki rhb ie in t he county of Kent, yeoman," he req ueste d buria l i n the chur chyard at Horton and bequeathe d 40 s hilling s t o his poor ne ighbors of Horton to be di stribut ed at th e di scretion of th e minister and churc h wardens . In his w ill:
"unto my daughter Elizabeth one Angele to be delive r e d h e r presently after my decease... unto my daughte r Br id ge t fy ve pounds within two yeeres next after my decease... unt o A l i c e my daughter tenne pounds [at date of marriag e o r a t 2 0 ye ars of age]... unto Martha my daughter other tenne poun d e s t o b e paid unto her as to her sister Alice [margin a l no te ' whic h paid to her at her day of her marriage in hande'] ...unt o J a n e m y daughter [£ 10 on the same terms]. And yf y t so h ap pe n th at any of my said daughters Alice Jane and Martha shall depa r t e t h is liffe b[e]fore the tyme aforesaid wherein the y o ug h t t o receave their portions, then my will is that their said porti o n s s h all remayne to be equally devided amongst the m o r s o man y o f them which shalbe lyvinge then....yf yt so happen that a l l m y s a id daughters Jane Alice and Martha shall depar t e thi s lif f e before the tyme when their portions ought by this my will to b e p a i d t hem, then...their portions shall be equally dev ide d a mo ngs t my sonnes Henry, Thomas, and John...All residewe...unto El i z a b eth my wiffe, whom I do ordayne and make the sole E xe cu tr ix ..."
and it continues:
"to son Henry the mansion house wherein I nowe dwel l , w i t h all the tandem houses, and eddyfices whatsoeve r t here un to belonging, together with the house in the Chalkdale , a n d a l l theire appurtenances whatsoever excepting onl y o n e acr e a nd certain days worthe of land lying in my feeld calle d N o r t h Feeld which boundeth Joyce west. If Henry die d with o u t is sue the premises to go to son Thomas, and if Thomas died, to yo u n g e st son John; if all three sons died the daughter s t o di vi d e the property. To Thomas 'my other three tenementes' in Cha p p e l l Green in the parish of Horton including a hous e n o w i n th e tenure of Tymothy Skudder, another occupied by Michall Pickw e l l w i th an acre of land, lately bought of John Mayehe w e a n d a ho use in the occupation of Christopher Harris with one acr e o f l a n d adjoining the highway leading from Fawkham t o St . Ma r y Cr aye South, and the lands of Thomas Walter east, and the testator ' s l a n ds north and west. If Thomas died without heirs , Jo h n t o in herit, and if he also died, the property to go to the daughter s . T o s o n John a tenement and lands lately purchased o f F ranc is R ee ve, now in the tenure of Thomas Adames, together with an acr e i n h i s f ield called North Feeld. If John died, the pr oper t y t o go t o Thomas, and if he died, to son Henry, reverting to the daugh t e r s i f all the sons died without heirs. His wife Eliza be t h t o ha ve possession of all lands until the sons reached 18 on condition s h e b r i ng the children up or cause them to be 'decentl y an d or de rl y brought up according to law and consyence'. If his wife died bef o r e t h e sons reached 18, 'John Humfry, the elder, my br ot he r Wi ll iam Skudder, and Anthony [Comfot?] to have the use of th e l a n d s and children s portions for bringing them up."
Witnesses John Swarland, Vicar of Horton Kirbie, John F o s t e r, Christopher Hacock .
3. Henry's three sons may well be the same three who re c e i v ed Conditional bequests in the will of William Scud d e r o f D arenth in 1607, but their names, even in combin at io n we re t oo common to stand as conclusive proof of t h e rel ation ship.
