South Carolina - This indenture made the Seventeenth day of February in the year of our Lord one thousand eight hundred and seventeen and in the forty first year of the Sovereignty and Independence of the united States of America Between Ezekiel Liepman of St. John's Parish in the State aforesaid Merchant of the one part, Sarah Thomas Benoist of the same place Spinster of the second part and Solomon Legare of the City of Charleston and State Aforesaid Planter and William Yeadon of the same place attorney at law of the Mind(?) part Whereas Philip Benoist late of St. John's Parish and state aforesaid Planter the father of the aforesaid Sarah Thomas Benoist, in and by a certain due poll made or mentioned to be made or on about the third day of March in the year of our Lord one thousand eight hundred and eight, for and in consideration of the natural love and affection which he bore toward his wife Ann Benoist and their children William Benoist and Sarah Thomas Benoist and for any other children who might thereafter be born and attain the age of twenty one years if male or said ages or days of marriage if females and in order to make the best provision for the, and also in consideration of one dollar to him in hand paid by Solomon Legare and John Cordes Prideau of the City of Charleston Planters he the said Philip Benoist did grant bargain sell and deliver unto the said Solomon Legare and John Cordes Prioleau certain negro slaves therein mentioned to have and to hold the said negro slaves with the future issue and increase of the females unto the said Solomon Legare and John Cordes Prioleau and the survivor of them his executors administrators and assigns In trust for the use and behoof(?) and to suffer mine the said Philip Benoist to receive and enjoy the profits and income arising from the labor of said slaves to his own use without restraint or interruption of the said Trustees or their executors or administrators and whom the death of the said Philip Benoist so permit the said Ann Benoist to have the use and occupation of the said slaves, and the issue of the females and to receive and enjoy the profits of their labor during her natural life without restraint or interruption as referenced, and upon the death of the survivor of said Philip and Ann Benoist to ? the said William Benoist and Sarah Thomas Benoist and any other children of the said Philip and Ann Benoist who might thereafter be born and attain the ages or day of marriage as aforesaid to have profits and enjoy the said slaves and the future issue and increase of the females to note the same unto the said William Benoist and Sarah Thomas Benoist and any other child or children to be born as aforesaid to his, her or their executors administrators and assigns freed from any further trust or limitation whatsoever - But in case only one of the said William and Sarah Thomas Benoist should attain the age of twenty one years or day of marriage then in trust for such survivor his or her executors administrators and assigns forever and in case neither of the said William and Sarah Thomas Benoist should attain the age of twenty one years or day of marriage then in trust to and for the said Ann Benoist her executors administrators and assigns for ever as in and by the said Deed of record in the office of the Secretary of the State aforesaid reference being thereunto had, may more fully appear, and whereas since the executing of the same deed the said Philip Benoist hath departed this life leaving the said Ann Benoist his widow and the said William Benoist and Sarah Thomas Benoist his only children and whereas the females of the said negro slaves have increased - since the execution of the said Deed and now amount to the number of Fifteen, and are named as follows Diana, Mary, Jim, Nelly and her six children Isaac, Katey, Sam , Mary, Diana, Bowe, Jenny and her two children Martha and Frances. Sue and her child Frank and whereas a marriage by God's ? is intended to be shortly held and solemnized between the said Ezekial Liepman and Sarah Thomas Benoist and whereas upon the treaty of and previous to the intended marriage aforesaid, it had been and is agreed by and between the said Sarah Thomas Benoist and the said Ezekiel Liepman that the share of properties that the said negro slaves with the future issue and increase of the females to which the said Sarah Thomas Benoist is entitled shall be by her granted bargained released and assigned to and vested in them the said Solomon Legare and William Yeadon and the survivor of them his and their executors administrators and assigns upon the special trusts and confidence and to and for the several uses interests and purposes hereinafter mentioned limited ? and declare of one concerning the same Now this Indenture ? in pursuance of the said agreement and in consideration of the said intended marriage, and also of one dollar to the said Sarah Thomas Benoist in hand ? the receipt whereof is hereby acknowledged and for ? other good causes and considerations here thereunto especially moving, she the Sarah Thomas Benoist by and with the privilege(?) and consent of the said Ezekiel Liepman her intended husband certified by his being a party to and executing these presents hath granted bargained and sold and by these presents doth grant bargain and sell and in ? open market deliver unto the said Solomon Legare and William Yeadon and the survivor of them, this and their executors administrators and assigns all the estate right title interest claim and demand whatsoever of the said Sarah Thomas Benoist of in and to the premises and every grant and parcel thereof To have and to not(?) the said negro slave with the future of issue and increase of the females with the said Solomon Legare and William Yeadon and the survivor of them his and their executors administrators and assigns up9on the special trusts and confidences Nevertheless and to and for the several uses intents and purposes herein and Truly intended to be made limited and expressed and declared of and concerning the same and as for as and concerning the said several uses intents and trusts herein and hereby intended to be made limited and expressed of the said negro Slaves of the said Sarah Thomas Benoist each and every of the parties to their Indenture hath agreed that the same shall be limited settled and assured in manner following, that is to say in Trust and to and for the said Sarah Thomas Benoist her executors administrators and assigns until the solemnization of the said intended marriage and from and after the solemnization thereof Then in trust that they the said Solomon Legare and William Yeadon and the survivor of them, his and their executors administrators and assigns do and shall during the joint lives of the same Ezekiel Liepman and Sarah Thomas Benoist will and truly permit and suffer the said Ezekiel Liepman to have the use profits on and enjoyment of the said negro Slaves and the future increase of the females and to receive and take the income proceeds and profits arising or proceeding there from to his own proper use benefit and behalf for the support and maintenance of him the said Ezekiel and his said wife and such children as they may have without any constraint restraint or interruption of the said Solomon Legare and William Yeadon or the survivor of them his or their executors administrators or assigns, but it is hereby expressly understood and declared by and between the parties to these presents that the property hereby granted and assigned is to be held by the said Solomon Legare and William Yeadon and the survivor of them his and their executors and administrators free from and by no means subject to any of the existing debts or engagements of the said Ezekiel Liepman or any future debts or engagements that he may incur or enter into and upon the death of either of them the said Ezekiel Liepman or Sarah Thomas his wife, thereupon this further Trust and confidence that they the said Solomon Legare and William Yeadon and the survivor of them his and their executors administrators and assigns do and shall well and truly permit and suffer the survivor of them the said Ezekiel Liepman and Sarah Thomas his wife as the case may be, to have the use possession and enjoyment of the said negro slaves with future issue and increase of the females and to receive and take the income proceeds and profit arising or proceeding here from to the proper use benefit and behoof of such survivor and the issue of this marriage (in case the said Ezekiel Liepman should be the survivor) during the natural life of such survivor for their joint support and maintenance, without any restraints control or interruption of the said Solomon Legare and William Yeadon or the survivor of them his or their executors administrators or assigns and upon the death of the such survivor Then in trust to and for the use benefit and behoof of the issue of said Ezekiel Liepman and Sarah Thomas his wife who shall be alive at the time of the death of the survivor of them, and who shall live to attain the several and respective ages of twenty one years or said ages or days of marriage if females, to note the said trust estate upon their attaining the said ages and days of marriage to such issue, if more than one of them their executors administrators and assigns forever as tenants in common and not as joint tenants, and if but one, then to him or her, his or her executors administrators and assigns forever freed from and without any other Trust whatever and in case the said Sarah Thomas Liepman should be the survivor then in trust that they the said Solomon Legare and William Yeadon and the survivor of them his and their executors administrators and assigns do and shall well and truly permit and suffer the said Sarah Thomas Liepman to have the use possession and enjoyment of the said negro slaves with the future issue and increase of the females and to receive and take the income proceeds and profits arising or proceeding therefrom to the proper use benefit and behalf of the said Sarah Thomas Liepman and the issue of this marriage or any future marriage during the natural life of the said Sarah Thomas Liepman for their joint support and maintenance free from and by no means subject however to the debts or engagements of the said Sarah Thomas Liepman during her widowhood or to the debts or engagements of any future husband of the said Sarah Thomas Liepman without any restraint control on the interruption of the said Solomon Legare and William Yeadon or the survivor of them his or their executors administrators or assigns and upon the death of said Sarah Thomas Liepman then in trust to and for the use and benefit and support of the issue of this or any future marriage as aforesaid who shall be alive at the time of the death of the said Sarah Thomas Liepman and who shall live to attain the several and respective ages of twenty one years or said ages or days of marriage if females To hold the said trust estate upon their attaining the said ages or days of marriage, to such issue if more than one, their executors administrators and assigns forever as tenants in common and not as joint tenants and if but one then to him or her, his or her executors administrators and assigns forever free from and without any further or other Trust whatever But in case it should so happen that either of them should die without issue, then upon the death of either of them the said Ezekiel Liepman and Sarah Thomas his wife without issue, upon this further trust and confidence that they the said Solomon Legare and William Yeadon and the survivor of them his and their executors administrators and assigns do and shall permit and suffer the survivor of them to take and enjoy the same negro slaves and the future issue and increase of the females To hold the same unto such survivor his or her executors administrators and assigns forever fully acquitted and discharged of and and from all further Trust confidence limitation or appointment howsoever. And it is hereby declared and agreed by and between the parties to these presents that in case the said Ezekiel Liepman and Sarah Thomas his wife, or the survivor of them shall be minded or willing at any time or times during their coverture(?) or whether either of them shall be ? or married to sell and dispose of all or any part of the said Trust Estate to convert the same into money in such case it shall and may be lawful to and for the said Ezekiel Liepman and Sarah Thomas his wife or the survivor of them to sell and dispose of all or any part of the said Trust Estate to such person or persons and for such price or prices as they or the survivor of them shall think fit and expedient and the said Solomon Legare and William Yeadon do hereby covenant promise and agree to and with the said Sarah Thomas Benoist that they the said Solomon Legare and William Yeadon and the survivor of them his and their executors and administrators shall and will assign transfer and dispose of all the said Trust estate or any part hereof to such person or persons, and to and for such uses purposes and estates as they the said Ezekiel Liepman and Sarah Thomas his wife or the survivor of them shall from time to time by any writing or writings under the hands and seals of said Ezekiel Liepman and Sarah Thomas his wife or the survivor of them, attested by two or more credible witnesses direct or appoint To always and it is hereby agreed that the monies arising by or from such Sale and disposed or the securities for the same uses intends and purposes and subject to the same provisoes and agreements as are herein before mentioned and declared of and concerning the said Trust estate And the said Ezekiel Liepman for himself his heirs executors and administrators doth by these present covenant promise and agree to and with the said Solomon Legare and William Yeadon their heirs executors administrators and assigns, that the said Ezekiel Liepman his heirs executors administrators shall and will from time to time and at all times hereafter upon the reasonable request of the said Solomon Legare and William Yeadon and the survivor of them his or their heirs executors or administrators make do and execute or cause or procure to be made done or executed all such further and other lawful and reasonable acts deeds and conveyances in the law for corroborating and confirming of these presents and for the further and better conveying assigning and assessing all and singular the premises herein before mentioned and intended to be granted bargained sold, released and assigned unto the said Solomon Legare and William Yeadon their executors administrators and assigns, as by them or the survivor of them his or their counsel learned in the law shall be reasonably devised advised or required In witness whereof the parties to these presents have hereunto interchangeably set their hands and seals on the day and in the year first written - Ezekiel Liepman (LS) Sarah Thomas Benoist (SI) Solomon Legare (Sl) Wm Yeadon (LS) Signed sealed and delivered in presence of Mary Carr, John Yates

General Notes for Child Josephine Felicia Liepman

Place of death is listed as Warren, Marion County, Missouri. The papers of Alice Gary Early show Shelbina, MO. Source: Application papers for The National Society of Colonial Dames of America in The State of South Carolina for Mrs. Philip DuTart Pinckney, full maiden name: Nancy Patricia Gary. ************************************************************************** *************************************** Ezekial Liepman - his only known wife,Sarah Thomas Benoist. Sarah, shown as widow of Ezekial Liepman, married Thomas Gelzer in 1824. Josephine Felicia Liepman - only known child of Ezekial - married James J. Clark (1844) James J. Clark was born in 1824, would not think he was much older o younger than his wife, Josephine. She must have been born by 1824. Thus my conclusion about Sarah being Josephine's mother. She must have been left a widow shortly before or shortly after Josephine's birth. Josephine and James had one child, Mary Anna Clark, born 1845 on Edisto. Josephine died in Shelbina MO in 1850. James must have then come "home" either alive or dead also in 1850 (after Josephine's death) as he is buried on Edisto. Not sure where Josephine is buried, but it appears in Shelbina, MO. Mary Anna would have been left as a five year old orphan. Mary Anna died also in Shelbina MO in 1881 at the age of 36. Her husband , the Union Army Capt.,Andrew Nunn Gary, born in Warren City, NJ., was buried at New Brookland, SC in 1901, so apparently he moved back? to SC or they lived in SC all along, though Mary Anna is buried in Shelbina (??? - maybe next to her mother?). Maybe both Josephine(documented) AND James died in Shelbina, James was shipped back to Edisto to be buried (documented), left this little girl, Mary Anna, who was raised in Shelbina by relatives or friends, Mary Anna then met and married Andrew Gary in Missouri and married him in 1865(documented) at the close of the Civil War. Then perhaps Mary Anna's roots were calling and they moved back to Edisto because in 1872, Harry Miller Gary, our great grandfather was born on Edisto of these 2 parents. I can only begin to imagine what Mary Anna's Clark relatives thought of this union. All the whites evacuated from Edisto during the entire Civil War. All of the abandoned plantations were either taken over as Yankee headquarters or the family slaves took over the houses. It couldn't have been a happy return for most of them after the war. Of course, another possibility is that Andrew was stationed on Edisto and that Mary Anna had been raised on Edisto by relatives and she met him upon her return to the Island after the War, when Federal troops were still "occupying" the Island.

Will of William Benoist:

State of South Carolina. In the Name of God Amen. I William Benoist of the City of Charleston and State aforesaid being weak and infirm in body but of sound mind memory and understanding praised be God for the same do make and declare this my Last Will and Testament in manner and form following that is today I recommend my Soul to the Almighty God and my body I wish decently interred at the side of my Mothers grave in the burial yard of Biggins Church in St. Johns Parish Berkley and as to the worthy property with which I have been blessed I give devise and bequeath the same as follow. First, after the payment of all my debts, funeral expenses and other incidental charges I with my two Negro slaves named Isaac and Katy to be sold by my Executors herein after named as soon after my death as it can be conveniently done, and if it can be effected I should wish them to be sold to Mr. William ?eree of St. Johns Parish aforesaid, Item out of the proceeds arising from the sale of the above mentioned Negroes. I give grant devise and bequeath unto my friend Alexander Markey the sum of Five hundred dollars upon this trust and confidence, that he shall invest the same in the Bank as other Stock and apply the Intent thereof to the support of a colored child named Martha the property of Mr. Winthrop and the daughter of a woman named Isabella formerly the property of Mr. Thomas Packer but now belonging to the said Winthrop/ during his Life and after her death should her Mother survive her, then to apply the same to the support of the said Mother in Like manner as is directed with regard to the child. But should her Mother not survive her, then I give devise and bequeath the said sum of five hundred dollars unto my said friend Alexander Markey as a reward for his friendship and trouble in attending to this part of my will. Item whatever balance may remain of the proceeds of said sale after deducting the sum above mentioned I give devise & bequeath the same to my Sister Sarah Thomas Gelzer lately Sarah Thomas Liepman for her sole and separate use and behoof Item I give devise and bequeath unto my Said Sister Sarah Thomas Gelzer a Bond in my possession executed to me by Mr. William Aleree(?) of St. Johns Parish aforesaid dated the Twenty Eighth day of March last conditioneds for the payment of Six hundred and thirty seven Dollars with Intent from date payable on the first day of January last (?), and upon which however some payments have been made and the mortgage of Six Negro Slaves Liz(?), Molly, Mary, Diana, Bean Peter and Tom, given to secure the payment of the said Bond, to be disposed of, or used by her in whatever manner she may think proper. Item. I give devise and bequeath to my said sister such portion of cash if any Shall remain after defraying Expenses which I may leave at my death - Item. I give grant and bequeath unto Mrs. Mary M. Hatch with whom I now board the bed and bedding of which I may die on(?) and to my Said friend Alexander Marky my watch and all my Working Tools. Item. I wish my uniform Dress to be delivered to the Captain of the Charleston Republican Artillery for the use of any person who may be disposed to become a Member of that Company. All the rest and residue of my property of what nature or kind is whatsoever I give devise and bequeath unto my Said Sister Sarah Thomas Gelzer. And Lastly I do nominate contribute and appoint my friend Alexander Markey and my Brother in Law Thomas Gelzer Executor of this my Last Will and Testament hereby revoking and making void all and every other Will & Testament.
