Orange County Deed Book 3, p 137 James Cozart acquired 698 acres on the Flat River in Orange County on 15 July 1783 from John Brown for 200 pounds. James Cozart acqired a tract of land on Dials Creek on 16 Sept 1783 from Arthur Magnum.
Bastardy Bonds - Bety J & Edwin A. Camin 1990 Bastardy Bonds were posted to protect the county or parish from the expense of raising an illegitimate child. When pregnancy or birth of such a child was brought to the attention of the court, a warrant was issued and the woman brought to court. She was questioned under oath and asked to declare the name of the father. The reputed father was then served a warrant and required to post bond. If none was named, the woman, her father, or some other interested party would post bond. Sometimes the woman and reputed father posted. If no bond was posted and no father named, the woman could be sent to jail.

All children referred to in James' will were born to him and Sarah Brinkeley, even though they didn't formally marry until 1796.
He acknowledged the first five children with the Brinkley middle name in his will, and he must have gone to court and legitimized them before he died, but I have not seen a document to that effect.

Hiram never married and his siblings were heirs of his total estate after his death in 1816. His land was purchased by his first cousin, Hubbard Cozart, son of Jacob. One of Hiram's sisters, who was born after the marriage of the parents, disputed this settlement, or her husband did on her behalf.
It was at this point that Hubbard filed a paper with the court declaring that he knew of his own knowledge that Hiram and four of his siblings were born of the body of one Sarah Brinkley before the benefit of matrimony with said James Cozart. James and Sarah were born on 23 Aug 1796.
Hubbard was likely casting a question as to whether this sister was in fact Hiram's sister at all. And of course, whether she had any right to question the estate settlement.
