General Notes (Husband)
Evidence taken before a Jury of inquest 24th & 25th of Feby atthehouse of William Merchant in Edgefield District over the dead bodyofEdmund Brown of Greenvill District.
Aldridge Green Sworn. Says that Carson Warren came up to thewagonswhilst watering their horses at Wm Merchants well, and proposeda Swapof horses and very soon asked for some Spirits, and followed toourcamp, and after being repeatedly asked for spirits. Mr. Brownthedeceased gave him (Warren) a drink; and he continued to insistformore, and refused to give him any more. Warren proposed to givethedeceased a bottle full of Spirits if he would send to his house.Thedeceased then gave him Carson Warren more Spirits, and in order togethim Carson Warren off, from the Camp, agreed to send for the bottleofspirits, and engaged Franklin Orr to go with Carson Warren tohouseand get the bottle full Mr. Carson Warren returned back to thecampbefore Orr did. When he arrived, he Carson walked up to thedeceased(who was lying down and appeared to be a Sleep) and pulledhim, andordered the deceased to get up the Warren cursed the deceasedfor adamned son of a bitch. Brown told Warren that he must not repeatthatagain, that his mother was a decent woman and he would not allowanyman to call her bitch. Warren repeated the Same several times.Warrenthen drew back a large black bottle in a striking position. WhenBrownthe deceased told Warren not to draw that on him, Warren thenwalkedround the fire and picked up an axe walked farther off. BrowntoldWarren not to take off an(y)thing belonging to the wagons. Warrenthenthrew the axe back. I do not know that he did this with anyintentionof hitting any person, thought it came near Striking one ortwo Warrenthen (took) a few steps and picked up a piece of lightwood, went alittle farther from the fire and said I am not far enough.Thelightwood was then thrown and Struck our tent and passed overthefire. Mr. Orr I think, picked up the lightwood and he and Mr.Brownthe deceased walked round the test to where Mr. Warren had passedwhenI saw Warren throw a large bottle in the direction of Orr andBrownthe bottle Struck the wagon tire it Struck one of one Mules onthenose and cut it badly. A fight then commenced between Orr andWarrenor Brown and Warren I do not know which; probably with both IfoundOrr on Warren & Brown holding him by the hand. I asked them toletWarren go and they done so. Warren then left the camp with thethreatthat he would see them again by day, or before day I do notknowwhich. We all retired to rest until about three o'clock when Iwasalarmed by the busting of a cap. I instantly rose up. Idistinctlyheard the order given Score them George, Score them boys, and anothercap was bursted. A third cap was bursted I think at me by anegroholding a pistol in his hand. I saw Mr. Warren with a doublebarrelgun in his hand going in the direction where a gun was fired bysomebody and the deceased killed. Sworn to before me this 24th day Feb 1853 Aldridge Green D White C.E.D.
Feb 25 William Orr Sworn, Says that Mr. Warren came up to the wagonsatWilliam Merchants from there he came to our camp and proposed aswap ofhorses. He also asked for spirits. Brown the deceased gavehim a drink, and he very soon asked for more, and the deceased refusedto give himany more, but Warren continued to insist until thedeceased gave himmore about this time I went in my wagon to bed andin a short time Iheard something like a fight I got out of my waginand saw Mr. Warrenon his elbows and knees. Brown the deceased hadhold of him and my sonwas standing a few paces off. I told them notto hurt Warren and tookhold of his hand and helped him up and Warrenwent off in the directionof home. I thought Warren intoxicated, andWalked some distance on theroad to see if he was not down. At a latehour of the night I wasaroused by a considerable noise in our campand the fire of a gun. Igot out of my wagon found Brown lying dead.
Sworn to before me William Orr this 25th Feby 1853 D. White C.E.D.
Franklin Orr Sworn, I saw Mr. Warren for the first time atMr.Merchants well, he there Bantered Mr. Brown the deceased for ahorseswap and asked for some spirits, after we took up camp he came tousand asked again for spirits, and the deceased gave him a drink.Aftersupper Warren proposed to give Brown a bottle of whiskey in ordertoget him from the camp. I agreed to go with him but Warren returnedtothe camp and found Brown lying down. Warren took hold of Brownsfeetand cursed the deceased for a damn son of a bitch. Brown toldWarrennot to repeat again his mother was respectable and not a bitch.Warrenholding a bottle in his hand drew it back like throwing it.Brown saiddont throw that bottle at me. Warren then stepped off a fewsteps andpicked up an axe. Brown told Warren not to take off any thingfrom thecamp, and Warren then picked up a piece of lightwood, threw itat thetend. He Warren walked into the road & bantered for a fight.Brown andwalked round in that direction and Warren threw a bottle atme, butone of th emules. I then Struck Warren with my fist, andknocked himto his allfours, and jumped on and gouged him. My fathercame up andtold to let him go, and I done so. Mr. Brown I thinkstamped Warren. Iwith my father helped Warren up and told him to gooff and he wentamong the horses and Brown knocked him down again. ThenWarren leftthe camp with the threat that he would see us again tonight or in themorning. Warren I think, was gone one or two hours whenhe returnedwith two negro fellows with him, when our camp was alarmedby thebursting of a cap and the order given; Score them George Scorethem.Brown and myself both rose up. I saw two negro fellows. I pickedup apiece of lightwood and passed round our test, where I saw a negromanwith a stick in his hand when the negro saw me with the pieceoflightwood. He changed his direction. I saw at this time a gunraisedby some man. The gun was fired & Brown killed.
