James Clark, son of Jeremiah and Sarah Baynard Clark witnessed his father's will in 1728. As he had to be 16 yrs. of age to witness the will, and his mother's first husband died in 1710, he was born about 1711/1712. He made his will April 16, 1750, and it was recorded June 29, 1750. Will of James Clark (1): In the name of God, Amen. I James Clark of Colleton County in the province of South Carolina Planter being sick and weak of body, but of sound and disposing mind and memery thanks be given to Almighty God for the same but considering the uncertainty of this mortall Life do make and declare these presents to be and contain my last Will and Testament. First and principally I recommend my mortal spirit into the hands of Almighty God my Creator trusting in the merit and Intercession of my Blessed Savior for pardon and remission of all my sins and a happy admittance into the regions of bliss and Immortality my body I commit to the earth from whence it was taken to be decently Buried at the discretion of my Ezors. hereinafter named and touching the disposition of such worldly Estate with which it hath please Almighty God to bless me I give divise and bequeath the same in manner and form following, that is to say First I will and order that all my just debts and funeral charges be paid and Satisfied with all convenient speed after my Decease by my Exors. hereinafter nominated and appointed and that no division or Separation of my Estate be made 'till after my Debts and Expenses aforesaid are paid and discharged. Item. I give and bequeath to my Dearly beloved Sister Martha Eaton One Hundred Pounds Currency by my Exors. hereinafter named to paid in twelve months after my Decease. Item. I give and devise unto my well beloved Brothers in Law William Jenkins & William Lawton or to his heirs or assigns forever in trust for and for the use and support of the Gospell in the Presbyterian Congregation in Edisto Island and for no other use whatever to be paid in twelve months after my Decease by my Exors. hereafter named One Hundred pounds Currency. Item. I Give and Bequeath unto my Beloved Son James Clark all that part of a tract of land left by my father to be divided between my brother Jeremiah Clark and myself which said Land was after my father's death divided between my brother and I by Henry Young and to have and to hold the same to my said son James Clark (2) his heirs and assigns forever. Item. I give and bequeath unto my beloved Son James Clark (2) all that tract of land which I bought of Mr. Daniel Mitchell to have and to hold the same to my said Son James Clark his heirs and assigns forever furthermore I will and order that all or any part of my aforesaid Lands which are already cleared be rented out by my Exord hereinafter named Allowing only pine timber for fencing and firewood be cut down that is to say no oak or other profitable timber beside pine as aforesaid and in case it should so happen that my son James Clark should depart this life without any Lawfull Issue or attain the age of eighteen years then I give devise and bequeath all that part of my lands lying and being on the Southwest of the high roads as it is now laid out to my beloved Nephew James Lardant Clark to him his heirs and assigns forever. Item. I Give Devise and bequeath in Case of my Son James Clark's Death as above mentioned before he attains to the age of eighteen years or without Lawful Issue all the rest and Residue of my Lands unto my Nephew Jeremiah Clark his heirs and assigns forever but if it should so happen that either of my said Nephews should die without Lawfull Issue then I give and Bequeath the said Lands to Survivour of them their heirs and assigns forever. I give devise and bequeath to my son James Clark a negro boy called A the said James Clark during his minority and to his heirs and assigns forever. Item. I will and order that the residue of my personall Estate be sold within twelve months after my decease by my Exors. hereinafter named; and the money arising form the sale to be put out to interest and the Interest arising from the moneys so put out to be for a Christian Education and Support of my Son James Clark. Item. I Will and order that the Surpluss Interest money after his education and support till he attain to the age of Eighteen years (if Ny) with all my Estate both real and personal be Delivered to my Son James Clark at the aforesaid age of Eighteen Years and I herein Declare him to have been born on the Sixteenth day of October in the year of our Lord one thousand Seven Hundred and Forty Four but if it should so happen that my son James Clark should die before he attain the to the age of Eighteen years or without Lawfull Issue then I give and bequeath unto my brothers in Law William Jenkins and William Lawton two hundred pounds currency more in trust for and for the use and support of the Gospell in the Presbyterian Congregation on Edisto Island and exclusive of the one hundred aforegiven in this my will and all the rest and residue of my personal Estate I will and order to be Equally Divided between and among my nephews and nieces that are now living Likewise including the children that may hereafter be born of my Beloved Sister Martha Eaton to be equally divided by my Exors hereinafter named or by any that they may order and appoint share and share alike between and among the children that may be born of my aforesaid Sister Martha Eaton and living at the time of my son James Clark's Death and John Jenkins and William Jenkins Josiah Lawton Wm. From a schedule of the property of the Presbyterian Church on Edisto Island taken in 1755, it is shown that James Clark and James Lardant Clark were among the donors of the Church, each having given 100 L. Source: " Ramsey's History of SC", vol. 2, p. 559. ************************************************************************** *************************************** James Clark and Joshua Grimball were appointed tax-enquirers and collectors for Edisto Island, SC, in 1739. Source: Statutes at Large, Vol. 3, p. 529 ************************************************************************** *************************************** By 1800 Edisto Island, South Carolina, had been settled by Europeans and Africans for more than a century. Most historians believe English settlers were on the island as early as 1680, only ten years after the first permanent colony in Carolina was established at Charles Town. Present-day "Cypress Trees" (plantation) seems to have been part of a somewhat larger plantain during the first century. The 1803 surveyor noted:
N.B. This Plantation is part of 300 acres granted to Joseph Palmenter the 1st Sep 1697. together with 20 1/2 acres bought by Sarah & James Clark of Matthew Croose (Crews?) the 18th April 1728 in order that the Pub. Road might become the LIne. J.D. Family records contain nothing about Joseph Palmenter, the original grantee. But this note tells us that the future "Cypress Trees" had been acquired by the Clarks by 1728. The James Clark mentioned in this note was probably James Clark I (1707?-1750), grandfather of the 1803 owner. Sarah Clark was apparently his mother. Little is known about the land's use before 1803. Lying as it does some distance up a small river, during an era of predominantly water transportation, "Cypress Trees: may have remained largely forested during the 18th century. But since the Clarks had invested money in the land by 1728, it seems more likely that the high ground was cleared and planted around that date or shortly after. Issue: Saturday, April 10, 1790 ************************************************************************** *************************************** "A census of the Island, taken at this time, 1808, would rate the white population at 236 inhabitants. Of these 111 are males, and 135 females. Of the males 37 are married, 4 are widowers, 9 natives of Europe, and 2 of the middle states; of the females 37 are married, 12 are widows, and all are either natives of the Island or the adjacent parts of the State. The births are to the deaths annually as 13 to 11. Nevertheless, the white population decreases in consequence of the numbers who leave the island." "From the return made to the tax-collector of the district for the year 1807, it appears that the black population of the Island exceeds by a few infants and newly bought Africans, 2,609 slaves. If sold in gangs of families, these slaves average one with another, $430. An active young fellow sold detached from his family, readily commands from $700 to $800, and young wenches in proportion. These is a disposition in the islanders to treat this patient and laborious race with indulgence and to meliorate their condition. They are never strictly restrained or stinted in their allowance. The instruction commonly given to those who distribute out their weekly portions is, 'let them never want, but do not suffer them to waste.' Exclusive of hats, shoes, salt, tobacco, pipes, and other occasional considerations, every grown negro is annually furnished with two suits of clothes, or 12 yards, partly plain and partly osanburgs, or some adequate substitute, for their summer and winter wear. The boatmen are generally provided with surtouts of the fear-nought description, and greater attention than formerly begins of late to be paid to their accommodation and comfort, in a more enlarged and improved construction of their dwellings. Some of the planters have it in contemplation to furnish them with regular rations of beef or some other animal food, particularly during those stages of the year in which they are most exposed to greater and more constant exertions of labor." "The Climate of Edisto may be considered as sickly. In the course of fifteen years, a number greater than three-fourths of the inhabitants have died. Some families in that period are extinct, and in all of them death has been once or twice, and in some three or four times an unwelcome visitor. Two funerals have occurred in a day but the instances are rare. And two instances can be adduced of two funerals in a family in one day. From the commencement of the sickly season in 1798, to the corresponding period of the succeeding year, 37 persons died. A great mortality for the population, and greater in proportion than that produced by the malignant fever which recently infested the cities of Philadelphia and New York. The deaths on Edisto Island, on an average of 16 years prior to the year 1808, were annually 11, or nearly one death for every 22 of the white inhabitants. It is some relief to this representation to reflect that the experience of the last few years supports the opinion that a summer residence on the sea bays connected with a moderate attention to regularity and exposure, secures the inhabitants from the autumnal fevers incident to the climate." It is possible that his father was Alexander Clarke, but has not been proven. Alexander Clark is represented as having lands on the mainland of South Carolina on the South Edisto River on an early map of the area, published by Edward Crisp in London, England, in 1711 from surveys taken prior to 1704. Alexander received land grants in this province in 1695, but the bounds are not given. An old index in the Charleston Probate Court shows that Alexander Clarke left a will, which was proved March 17, 1718. So far nothing further has been found relating to him, but the fact of his being in the same locality, makes it seem possible that he belonged to the same family, and was possibly the father of Jeremiah Clarke. As Edisto Island was settled by the second colony in 1680, it seems probable that either Alexander Clarke or Jeremiah Clark or possibly both were among this group of early settlers. Jeremiah Clark left a son, James, as one of his executors; therefore James was at least 21 years of age at the time his father's will was made. Allowing James to have been born when his father was 22 years old, this would carry the birth of Jeremiah Clark I back to 1685 or earlier. We do not know by which wife his children were born. His will mentions: Wife Sarah, equal part of my moveable estate with my daughters and to live upon my plantation. Sons - James Clark and Jeremiah Clark, all lands to be equally divided between them. Wife Sarah Clark and sons James and Jeremiah Clark and my daughters Phoebe Clark, Mary Clark and Martha Clark all the moveables belonging to my plantation to be equally divided between the. I give to my grand-daughter Elizabeth Sams when she is 18 years old 5000 weight of merchantable rice; if she dies before she comes to that age, then the said rice to be equally divided between my wife and children. I give unto my son-in-law William Binyard (sic) and to my daughter-in-law Sarah Fry, 1000 weight of merchantable rice, 500 to each. I likewise appoint my wife, Sarah Clark, and my son, Jaems Clark, Mr. Ralph Bayley and Mr. Wm. Bowers my sole executors. James Clark, son of Jeremiah and Sarah Baynard Clark witnessed his father's will in 1728. As he had to be 16 yrs. of age to witness the will, and his mother's first husband died in 1710, he was born about 1711/1712. He made his will April 16, 1750, and it was recorded June 29, 1750. Will of James Clark (1): In the name of God, Amen. I James Clark of Colleton County in the province of South Carolina Planter being sick and weak of body, but of sound and disposing mind and memery thanks be given to Almighty God for the same but considering the uncertainty of this mortall Life do make and declare these presents to be and contain my last Will and Testament. From a schedule of the property of the Presbyterian Church on Edisto Island taken in 1755, it is shown that James Clark and James Lardant Clark were among the donors of the Church, each having given 100 L. Source: Statutes at Large, Vol. 3, p. 529 ************************************************************************** *************************************** By 1800 Edisto Island, South Carolina, had been settled by Europeans and Africans for more than a century. Most historians believe English settlers were on the island as early as 1680, only ten years after the first permanent colony in Carolina was established at Charles Town. Present-day "Cypress Trees" (plantation) seems to have been part of a somewhat larger plantain during the first century. The 1803 surveyor noted:
N.B. This Plantation is part of 300 acres granted to Joseph Palmenter the 1st Sep 1697. together with 20 1/2 acres bought by Sarah & James Clark of Matthew Croose (Crews?) the 18th April 1728 in order that the Pub. Road might become the LIne. J.D. Family records contain nothing about Joseph Palmenter, the original grantee. But this note tells us that the future "Cypress Trees" had been acquired by the Clarks by 1728. The James Clark mentioned in this note was probably James Clark I (1707?-1750), grandfather of the 1803 owner. Sarah Clark was apparently his mother. Little is known about the land's use before 1803. Lying as it does some distance up a small river, during an era of predominantly water transportation, "Cypress Trees: may have remained largely forested during the 18th century. But since the Clarks had invested money in the land by 1728, it seems more likely that the high ground was cleared and planted around that date or shortly after.
