Of the sons of Sir Thomas Colepeper Walter succeed e d t o a l l the estates except Exton on the death of hi s ha lf-b roth e r--Sir John--and was the only one to leav e mal e issu e. Th om as is recorded in most pedigrees to h ave di ed with out is sue , and Nicholas, although he doe s not nam e her i n his wi ll a t Lambeth, dated 16th Augus t, 1434, a nd prove d 20th Ja nuary , 1434/5, in which he m entions hi s brothe r Walter, hi s wif e Elizabeth and hi s daughter Be nedicta o r Bennett, an d desi res "sepeliend ' in ecclia an nunciacoi s beate Marie d e Begha m ante alt are sancti laur encii iuxt rem (?iuxta matr em) meam ," ha d another daughte r Joyce, wh o married Walte r Lewknor , o f Walberton, co. S ussex, fift h son of Sir Thom as Lewkno r , M.P. for Lewes.

Walter Colepeper, who continued the line, married Ag n e s , t he daughter of Edmund Roper, of St. Dunstans, Can te rb ur y, a nd is so described on her tombstone at Goudhu rst . S h e was a lso the widow of John, son of John de Bed gebu r y , a fact no t mentioned in the pedigrees recorde d in t h e Vi sitations, b ut which is amply evidenced by a n undat e d Chan cery Proceedi ng, temp. Hen. VI., where Wa lter Cou lp epir an d Agneis, hi s wife, late the wife of J ohn, so n o f John d e Beggebury an d Thomas Chaundeler, ch aplain , appe ar as pla intiffs in a di spute relating to p ropert y in Gou dhurst, Cr anbrook and Hawk hurst, which Jo hn, so n of Roge r de Beggebu ry, left to pay f or two chap lains t o sing mas ses for his s oul and for that o f Johan na, hi s wife. By th is marriage Wa lter Colepeper had , wi th tw o daughters

--Margaret, married to Alexander Clifford, and Eliza b e t h , married to John Hardes, of Hardes, co. Kent--thr e e so n s , Richard, John and Nicholas. Agnes, his wife, p re decea s e d him on the 2nd December, 1457, and was burie d a t Goud hu rs t, and Walter himself died on the 24th Nov embe r, 1462 , a n d was also buried at Goudhurst.

Richard and Nicholas, under somewhat romantic circumst a n c e s, married Margaret and Elizabeth Wakehurst, (grand da ug ht e rs and co-heiresses of Richard Wakehurst, sen. , o f Wak ehu rs t, in Ardingly). These two girls were conf ide d by El izab eth , their grandmother, Thomas Echyngham , Tho mas Hoo , Joh n Gay nesford and William Gaynesford, t heir g uardians , to t he car e of John Colepeper and Agnes , his w ife, th e forme r of who m "promysed on the faith e and trou the of h is body e and as h e was a gentylman, " that they s hould no t be wron ged. In spi te of this pro mise, however , he, wit h Richard a nd Nichola s his brethr en, "with forc e and arme s riotousl y agense th e Kynges p eas arayed in t he manr o f warre at Go utherst tok e and c aried" them awa y to Bobbin g, Alexander C lifford's pl ac e in Kent, and af terwards tra nsported them t o Londo n t o a place of John G ibson, "the s eide Margarete a nd E lizabet h at the tyme o f their takyn g away makyng gre t e and pittiou s lamentacio n and wepyng."

This high-handed proceeding on the part of the two fo r t u n e hunting brothers was productive of much litigati o n , a s El izabeth Wakehurst, grandmother of the two heir es se s, r efuse d to resign the title deeds of their estat es , an d i t was so me time before a peaceable settlemen t wa s obta ined . Richar d died without issue, but Nichola s bec ame th e ance stor of t he Colepepers of Wakehurst, a nd a s the bra ss to h im and hi s wife Elizabeth in Arding ly Ch urch show s ten son s and eigh t daughters, we may co nclud e that the y lived lon g and happi ly together. Previou s to this , howe ver, by a fine leviedin 1 320, pa rt of hi s estates, c onsisti ng of 2 messuages , 2 mills, 4 05acres o f land, 20 ac res of m eadow, 60 acr es of pasture , 80 acre s of woodand 2 0 shilling s annua l rental in Pepy ngbery, Th onebregg and Te udele,wer e set tled on himself a nd Marger y his wife for lif e, with re m ainder totheir son s Walter , John and Richard i n successi on . Much of Thomas Colpeper' s lands were seized b y the K ing o n November th e 6th, 1321 , onaccount of Thomas ' fel ony. Origin of Name and Coat of Arms

Name

With regard to the derivation of the name Colepepe r n o s a t isfactory explanation has ever been given, bu t as t he f ir s t of the family of whom we have any mentio n, th e "Reco gni to r Magnae Assisae tempore Regis Johanni s," i s calle d Thom a s de Colepeper, we may fairly conclu de tha t the na me eith e r bore a local signification, o r it refe rs to th e occupat io n, or calling in life, of t hose who f irst adop ted it. I f th e name is a local one t wo places h ave been s uggested f rom w hich it may be deri ved, viz., G ollesberghe , in Sandwi ch, co . Kent and Gold spur, or Culs pore, a hund red in the R ape o f Hastings. I f, on the othe r hand, the n ame is connec ted i n some wa y with the occup ation of thos e who first ass umed i t, th en it is argued t hat in the sam e manner as Cole proph e t means a false prop het, and Coletr agitour a false t ra itor , so Colepeper ma y mean a false pe pperer, or sham g r ocer, i .e., one who t raded outside th e Fraternity of P eppe rers, th e Guild whe nce sprang the Gr ocers' Company , whic h was incor porate d in 1345. Another s uggestion po ints to t he possibili t y of Colepeper meanin g Blackpeppe r, while ano ther hint s a t the likelihood of t here havin g been formerl y some i ndustr y in which the cull ing or p icking of peppe r may ha ve forme d one of the chie f branc hes.

The armorial bearings of the family, Arg: a bend engra i l e d , gu., may possibly furnish a clue to its origin. P ap wo rt h , in his Ordinary of British Armorials, mention s so m e six t y families as bearing the bend engrailed, bu t app ar entl y on ly two of them, viz., Chitcroft and Walr and, d isp laye d iden tically the same coat as the Colepep ers. A s Rob ert W alrand , in the Roll of Arms, temp. Henr y III. , appea rs a s the own er of this coat,1 the Colepep ers pro bably go t i t somehow th rough him, and they wer e using i t as earl y a s 3 Edward III . (1329), when John , the son o f Sir Thom as C olepeper, is re corded as beari ng it, and h is brothe r Richa rd differenced i t with a la bel of thre e points. Th e Chitcr ofts also were pr obabl y either Colep epers or clos ely conne cted with them , a s not only are th eir arms ident ical, bu t we find th e two fa milies associa ted together a t a very e arly peri od. In 129 9 Benedicta , daughter of Tho mas de Chit croft , granted lan d in Begha l, with a mill i n Pepinbury , t o Thomas, son of Th omas Co lepeper, and Marg ery his w ife, w hile in ll Henry I V (140 9) the names of Jo hn Chit croft an d Thomas Colepeper c hiv aler, appear couple d a s defendant s in an action brougl h t by John Mortymer, r e lating to th e manor of Asshen, co . No rthants. An invest i gation of th e early Walrand and C hitcrof t pedigrees wo ul d doubtless re veal some connectio n with Col epeper, bu t wo uld probably gi ve no clue to th e origin of th e name , whic h may, therefore , be left to t he choice of th e re ader o r to his further re searches

Most pedigrees agree in giving John as the Recognito r ' s s o n, followed by Sir Thomas as his grandson. If th e p ed igre e s are correct then this Sir Thomas, of Bayhal l, m us t hav e b een an old man in 4 Edward II. (1310). As sumin g t hat th e gr andfather was fifty years of age whe n he se rve d as Rec ognit or, then the two generations suc ceding h im m ust hav e covere d a period of some eighty ye ars. Thi s woul d make S ir Thoma s Colepeper, in 4 Edwar d II., whe n his so n Thoma s and Marge ry his with purchas ed of him 5 0 acres i n Foulsd en, a fairl y old man, and a lthough, h e indicted i n 1305, w ith his so n Thomas, fo r stealing th e goods of th e vicar o f Ringmer, w e can ha rdly believe t hat he took an y active p art in the ma tter.

Thomas de Colepeper is stated to have been a Recogn i t o r o f the Grand Assize, on the authority of Phillipo t t , i n hi s Villare Cantianum where he quotes "Bundel s o f in cert ain y ears in the Pipe Office," but no direc t ref erenc e bei ng giv en we have, unfortunately, been un able t o trac e him . We wou ld, however, point out tha t a Recogni tor wa s no t a Judge, a s is asserted in the a rticle refer red to.

The Grand Assize was not an assize in the sense wh i c h w e n ow use the word, but it was a proceeding or enq ui r y lik e a n assize of novel disseisin, or an assize o f mo r t d'anc esto r, &c., while the Recognitors, who wer e summ on ed on su ch tr ibunal, were the jurors whose func tion i t wa s to inve stigat e all cases involving question s of ri ght , and who, b eing pr obably neighbours of the d isputin g par ties, were bo und to " recognise" and speak t he trut h conce rning the matt er at iss ue. After remaining a close prisoner during the remain d e r o f t he reign in the Castles of Berkhampstead and Gl ou ce ster , Jo hn Colepeper was released on the accessio n o f Edw ard I II. , and in the restoration of confiscate d lan ds whi ch the n to ok place those of John Colepeper , of Lyn legh, w ere inc luded . He was alive eleven year s later, wh en Joh n Colepepe r, o f Lynlegh, with Johanna , his wife, a ppear a s deforcian ts i n a fine relating t o 20 acres of l and in W ythyhame.
