Henderson left Tennessee in 1836 for Texas to fight for the Texans Freedom from Mexico. He was captured at the Battle of Goliad, and on Easter Sunday, March 27, 1836, he was shot by the Mexicans. His parents both died within two years of this event due to the shock and grief of their lost son.

Hiram never married and his siblings were heirs of his total estate after his death in 1816. His land was purchased by his first cousin, Hubbard Cozart, son of Jacob. One of Hiram's sisters, who was born after the marriage of the parents, disputed this settlement, or her husband did on her behalf.
It was at this point that Hubbard filed a paper with the court declaring that he knew of his own knowledge that Hiram and four of his siblings were born of the body of one Sarah Brinkley before the benefit of matrimony with said James Cozart. James and Sarah were born on 23 Aug 1796.
Hubbard was likely casting a question as to whether this sister was in fact Hiram's sister at all. And of course, whether she had any right to question the estate settlement.
