General Notes (Husband)

The earliest notice of this family occurs in the time of Henry I., when Gilbert Mareschall, and John, his son , were impleaded by Robert de Venoiz, and William de Hastings , for the office of Mareschel to the king , but without success . The son (bearing the same surname, derived from his office), John Mareschall, attaching himself to the fortunes of Maud, against King Stephen , was with Robert , the consul, Earl of Gloucester., at the siege of the Winchester Castle, when the party of the empress sustained so signal a defeat. Upon the accession of Henry II., however, his fidelity was amply rewarded by considerable grants in co. Wilts; and in the 10th year of that reign, being then marshal, he laid claim, for the crown, to one of the manor's of the see of Canterbury, from the celebrated prelate, Thomas a Becket, who about that period had commenced his contest with the king. This John was succeeded by his son and heir, John Mareschall , to whom King Henr y II. confirmed the office of marshal , and the lands which he held of the crown of England, and elsewhere. At the coronation of Richard I., the John Mareschal l bore the great gilt purs, and the same year obtained a grant from the crown of the manor of Boseham, in Sussex, in fee farm, paying 42 pounds yearly, to the exchequer; with other extensive lordships. He died soon after, and it appear s with out issue, for his brother , William Mareschall, Earl of Pembroke, succeeded as his heir. We now come to then ephew of the said William , E arl of Pembroke, Sir Jo h n Marsh al, who married Aliva, e l der daughter and co-he i r of Huber t de Rie, feudal lor d o f Hingham, co. Norfol k , by whom he a cquired that lord ship . Espousing the cau s e of King John aga inst the baron s, Si r John Marshal ac qui red from the crown , all the for feite d lands of the E arl o f Evreux, in England , as als o the lan ds of Hugh d e Gornay , lying in the countie s o f Norfolk an d Suffolk , whereof t he said Hugh was posses s ed when he des erte d the royal ban ner; and he likewise o btai ned a gran t i n fee, of the offi ce of Marshal of Irel and. H e was s ubsequ ently, in the sam e reign, constitute d guardia n o f the marc hes of Wales, an d sheriff of Linco lnshire, a n d afterward s joined with Joh n Fitz-Robert, i n the sher iffal ty of th e cos. of Norfol k and Suffolk, an d the cus tody of t he cast les of Norwic h and Orford. He w as likew ise made gove rnor o f Dorcheste r Castle; moreover , he ha d the same year , liver y of the o ffice of marsha l of Ire land, and whatsoeve r di d appertai n thereto; so t hat h e should appoint a knigh t t o execut e its duties eff ectu ally. Continuing steadfas t i n his all egiance to Kin g Jo hn, he was made sheriff of W orce stershi re, and gover no r of the castle of Worcester; an d h e was o ne of thos e w ho marched with the king into the n orth , t o waste th e l ands of the insurrectionary barons the re. U p on the ac ce ssion of Henry III., Sir John Marshal wa s cons t itute d s heriff of Hampshire, and governor of the ca stl e o f De vi zes, in Wilts, and retained, during the remain de r o f h i s life, the favor of that monarch. He died in 12 3 4 , a n d was succeeded by his son, John.

John Marshal, who dying in 1242, was succeeded b y h i s s o n and heir, William.

William Marshal, who, adopting a different line of pol i t i c s, joined the baronial standard, in the 49th yea r o f t h e re ign of King Henry III., and died about the s am e peri o d (126 4), leaving two sons, John and William , the n under ag e, who , the next year, through the interc essio n of Will ia m de Say e, obtained the king's pardon f or the ir father' s t ransgress ion, and had permission t o enjoy h is lands, w it h whatever p ossessions they had , by gift o f Aliva, thei r g randmother.

The elder of these sons, John Marshal, died in the 1 2 t h y e ar of Edward I., and was succeeded by his son, Wi ll ia m Ma rs hal, who in the 34th year of Edward I., was i n t h e war s o f Scotland, and was summoned to parliamen t a s a B aron , fro m January 9, 1309, to November 26, 131 3. H e die d in t he nex t year, and was succeeded by his s on, J ohn.

John Marshall, 2nd baron, in the 7th year of Edwar d I I . , t his John attended the Queen into Scotland, an d th e en su in g year doing his homage, had livery of hi s lands , lyi n g i n the cos. of Norfolk and Lincoln. He d ied soo n afte r , abou t the year 1316, leaving his sister , Hawyse , wif e o f Robert , Lord Morley, his heir, who ca rried th e Baron y o f Marsha l into the Morley family, fro m which i t passe d int o that o f Lovel, and thence to th e Parkers , when i t fell i nto abeya nce, at the decease o f Thomas P arker, Lo rd Morley , in 1686 , between the issu e of that n obleman' s aunts, Kat herine, wi fe of John Sav age, 2nd Ear l Rivers , and Elizabet h, wife o f Edward Cra nfield, Esq. , and amon gst whose desce ndants i t so conti nues.

William Pantulf or Pantoul, also known as the Baron Wem , t a kes his name from one of the Norman domains of Roge r Mont go mery being his knight (see above) and probabl y a kinsma n o f Earl Roger. He also held Noron in Calvados . He was on e o f the Chief Officers in the administratio n of the Earld om o f Shrewsbury for Earl Roger. He was a t the Battle of H astin gs and received large grants. Dissa tisfied , however , he ma de a trip to Sicily in 1077, an d was offered, if h e would r emain, three towns in souther n Italy by fellow No rman, Robe rt Guiscard, the Duke of Sa lerno, who ruled mos t of souther n Italy. General Notes for Child John Fitzalan Earl Of Arundel

According to other sources, we know that John Fitz Alan was born 14 Sep. 1246, whereas the fine was dated 14 May 1260. As such, the fine was recorded a mere four months before John Fitz Alan reached his 14th birthday. The fine was evidently part of the preparations the parents of the two parties took immediately prior to the consumation of the marriage.

The wording of this fine reflects the fact that by medieval custom, couples betrothed as children were considered married, regardless of the fact that their marriage had not yet been consumated. As such, I believe it is incorrect to say there was a difference in Latin phrases, "led in marriage" or "married" in this time period. As we can see in this fine, the bethrothed couple are called "married," even though the fine makes it clear that the marriage was not consumated.

As a side note, the bride in this fine, Isabel de Mortimer, was grandaughter of the ever popular Gladys Dhu, daughter of Llewelyn ap Iowerth, Prince of North Wales. The marriage between Isabel de Mortimer and John Fitz Alan was in due course consumated and surviving children born to the marriage. The manor of Chipping Norton, co. Oxford mentioned in the fine descended in the Fitz Alan family until about 1385, when it was settled by Richard de Arundel, 11th Earl of Arundel, on his niece, Philippe Arundel, wife of Richard Sergeaux, in satisfaction of her claims on her grandfather, the 10th Earl's estate. The manor was subsequently held by Philippe (Arundel) Sergeaux's descendants.
