!Witnessed marriage bond of sister Elizabeth to James Gillespy, 5 January 1764, in Prince Edward County, VA (Prince Edward Co., VA, Marriage Bonds, 1754-1850, LDS film #0033254). Purchased 100 acres in Beverley Manor, 18 August 1773, from James and Elizabeth Gillespy (Augusta Co., DB 19:414). Gave Power of Attorney to William Finley of Wythe County, 24 January 1792 (Wythe County, DB 1:82); deeded 327 acres on Reed Creek to David and Samuel Finley of Lincoln County, KY, 12 June 1792 (Wythe County DB 1:84). Wrote will 6 July 1807 (Augusta Co., DB 10:172); probated 28 December 1807. Left land on Elkhorn, Green and Dicks River, KY to heirs ... Sons John, William and Samuel; daughters Sally, Peggy Huchison, Jinney Fraser. Also mentioned Peggy Mooney in his will. His son, William, later mentions Francis Marion Finley, son of Margaret Mooney in his will of 21 February 1836 (Augusta County WB 21:291).

!"About 1796 John [Hutchinson] and his wife moved from Virginia to Bourbon County, Kentucky near Paris. They were accompanied by William Frazier and his wife Jean Finley, a sister of Margaret. Both families resided on farms in Bourbon County, Ky. until 1806 when, because they were opposed to slavery, they removed to Greene County, Ohio." From Milford E. Barnes and Andrew Wallace Barnes, "John and Margaret (Finley) Hutchison and Their Descendants." Iowa City: 1965, p. 49.

!A copy of his will was sent to Scott County, KY, 15 September 1810 and was acknowledged in Scott County 1839 saying the original will of record was destroyed, but certified copy examined and ordered recorded (Scott County WB G:70-71). This occurred during the time the estate of John T. Finley was being settled in Scott County ... lending credence to the fact that John and Samuel Finley in Scott County were, in fact, this John's sons.


General Notes for Child Samuel Steele Finley

!Marriage bond of Wm. Finley and Sally Ramsey, where Samuel acted as surety, state he and Wm. are cousins (Chalkley II:339). However, the relationship is through their respective mothers, Martha and Sarah Steele, both daughters of Samuel and Mary (Fulton) Steele. Samuel appointed Ensign in Company of Infantry in 2d Battalion, 32d Regiment, 20 September 1796 (Chalkley I:285). See Finley vs. Tate (Chalkley II:212); named in Tate judgments in 1804 (Chalkley I:301). Marriage record in Chalkley II:317, 20 September 1796; also Chalkley II:355, gives date as 2 February 1796. Named in will of Samuel Steele (Chalkley III:187) and James Steele (Chalkley III:222).

!Based on information provided by Stella G. Finley, P.O. Box 612, Georgetown, KY 40324, Samuel and his brother, John, went to Scott County, KY about 1807. There is an 1807 deed to Samuel Finley from Cornelius Duvall (DB B:67). On 7 June 1813, a deed from Samuel Finley to William Finley of Augusta County for land lying in said county was acknowledged in Scott County Court (Scott County OB:B:290). Her notes also provide the following cemetery inscription (name of cemetery not given): "Samuel Finley who departed this life Dec. 21, 1833 in the 64th year of his age. He was a believer in Christ, happy in life, patient in death. Beneath this silent Tomb His lifeless body lies. His soul in spotless innocence Has risen to the skies." Also, "In memory of Martha Jane, wife of B.M. Hathaway, only daughter of Samuel Finley. Born Oct. 11th 1819, married April 7th 1840, died Feb. 3rd 1842." Her notes also include the following obituary of S. Thomson Finley, "Born Bourban Co, Ky. Aug. 2, 1815; Died Palmyra, Mo. Jan. 24, 1879, Dropsy; Son of Samuel and Martha Finley; Parents both sides, Scotch descent; immediate parents natives of Va., married March 25, 1841 to Ellen Bryan; daughter of the late Samuel Bryan of Fayette Co. , Ky. obituary speaks of him a Capt. Finley." Letters of administration were granted Jno (T. or S.) Finley for Saml Finley (date not given) in Scott County OB D:44-45.

Finley and B.F. Finley, 3 slaves with children, $500 for each year 1838 through 1840 (DB O:116); 12 September 1837, sale of John's estate (WB F:42 - 46); final settlement, April Court 1839, reported final balance $2279.74, accounts for widow's 1/3 and remainder to be divided among four heirs (WB F:396). The four heirs must include James H., Benjamin Franklin, Joseph Walker and 1 other (Mariah I?). His inventory shows accounts listing Thomson Finley (nephew, son of Samuel ?) and Mariah I(?) Finley (WB F:42). October Court 1839, entered copy of will of John Finley of Augusta County, dated 6 July 1807 (WB G:70); 16 October 1840, I Elizabeth Finley, wife of John Finley, dec'd relinquish all my interest in my dower of the estate of John Finley to his heirs, James H. Finley and B.F. Finley.

In 1860-1900 census, Bodega, Sonoma Co., CA. Bought first portion of what became 1000 acre ranch in 1867, originally part of Bodega Rancho. Appointed guardian of sister Elizabeth's children after husband (John Findley of Tulare Co., CA) was murdered. See "John and Keziah (Head) Finley," by Nettie McDonald, on file at Sonoma State University, Ruben Salazar Library, Special Collections. Died of mitral disease of heart and old age.

!Parentage speculative ... not in agreement with Stout. Married, 1st, a daughter of Rev. John Thomson (about 1740-1748); married, 2nd, Mary Caldwell (prior to 1750). Purchased the John Robinson property on South River of the Shenandoah in 1746 (Augusta Co. DB 1:77). Sold 2/3 to William and Robert Finley in 1750 (Augusta Co. DB 2:207-713). Sold remaining 297 acres in 1765 (DB 11:808). Bought 400 acres in Prince Edward Co. three months later (Prince Edward Co. DB 3:1). Sold that in 1773 (Prince Edward DB 5:63) and bought 327 acres on Sally Run, Branch of Reed Creek, in Montgomery County from John McFarland (Montgomery County Order Book 1:142). Deeded this property to sons, David and Samuel in 1779 in exchange for life care (Montgomery County DB A:283, A:258). Deposition ordered for Mary Finley, August Court 1782; done by William Davis, William Doak, William Ward on 2 September 1782. Died prior to 19 August 1782 when heirs gave legal notice (Montgomery Co. DB A:284).

!It was this John Finley who was instrumental in establishing Tinkling Spring Presbyterian Church near Staunton (Fisherville). One of five commissioners appointed to attend to the business affairs of the church in 1741. Served as an elder from about 1743 to 1763 (Wilson's "Tinkling Spring," p. 85, 431). Established a mill, authorized payment in financing the first church building; head of one of three congregational districts organized to support the Church (Wilson, p. 25, 72, 91). Justice of Peace in Orange County before 1745; same in Augusta after 1745 (Wilson, p. 109-109). Wilson believes he may have transferred his efforts to Brown's Meeting House (p. 166). However, this is more likely the contemporary John Finley who lived on Middle River.

!Bottom line. Do not confuse this John Finley with the John Finley who lived on Middle River and whose wife was Thankful Doak. They are two separate, contempory persons, not father and son.

Richard Sankey in Prince Edward County on 4 Jan. 1764 identifies Elizabeth as his wife's niece. Sankey's wife was Sarah Thomson, daughter of Rev. Thomson. See J.G. Purchased 100 acres in Beverley Manor, 18 August 1773, from James and Elizabeth Gillespy (Augusta Co., DB 19:414). Gave Power of Attorney to William Finley of Wythe County, 24 January 1792 (Wythe County, DB 1:82); deeded 327 acres on Reed Creek to David and Samuel Finley of Lincoln County, KY, 12 June 1792 (Wythe County DB 1:84). Wrote will 6 July 1807 (Augusta Co., DB 10:172); probated 28 December 1807. Left land on Elkhorn, Green and Dicks River, KY to heirs ... Sons John, William and Samuel; daughters Sally, Peggy Huchison, Jinney Fraser. Also mentioned Peggy Mooney in his will. His son, William, later mentions Francis Marion Finley, son of Margaret Mooney in his will of 21 February 1836 (Augusta County WB 21:291).

!"About 1796 John [Hutchinson] and his wife moved from Virginia to Bourbon County, Kentucky near Paris. They were accompanied by William Frazier and his wife Jean Finley, a sister of Margaret. Both families resided on farms in Bourbon County, Ky. until 1806 when, because they were opposed to slavery, they removed to Greene County, Ohio." From Milford E. Barnes and Andrew Wallace Barnes, "John and Margaret (Finley) Hutchison and Their Descendants." Iowa City: 1965, p. 49.

!A copy of his will was sent to Scott County, KY, 15 September 1810 and was acknowledged in Scott County 1839 saying the original will of record was destroyed, but certified copy examined and ordered recorded (Scott County WB G:70-71). This occurred during the time the estate of John T. Finley was being settled in Scott County ... lending credence to the fact that John and Samuel Finley in Scott County were, in fact, this John's sons.


General Notes for Child Elisabeth Finley

!Was living in Prince Edward County with her aunt and uncle, the Rev. Richard Sankeys, in 1764 when she married James Gillespie of Augusta County. This positively identifies her as a granddaughter of the Rev. John Thomson, through the John Finley who married a daughter of Thomson (J.G. Herndon, "Some of the Descendants of the Rev. John Thomson," Virginia Magazine of History and Biography, vol. 51, 1943, p. 394-404). She and her husband lived on the old Gillespie property on South River until 1787 when they sold their 300 acres on South River to Michael Coyner of Cumberland County, PA (DB 26:37). In March 1794, John Finley, in a suit with Matthew Gleaves stated he would obtain a deposition from James Gilaspy of Little River, waters of Holestine in New Territory (Augusta County, drawer 449).

Bought 165 acres in Montgomery County 24 August 1784 (Montgomery County DB A:332); surveyed 162 acres entered 3 August 1783, on 11 February 1785 (Surveys, p. 220). Served on jury of inquest in Montgomery County in 1785 through 1877 (Order Book 1:256, 272, 288; 4:1788-). Divorced wife Mary (Pettus) sometime prior to 15 January 1800, when son, Dabney brought suit for recovery of slaves (Wythe County DB 2:476-78). Wrote will 15 December 1801 (Wythe County WB 1:202), named wife, Judith, daughter Mary Ammy (Anne?), unborn child; children Esau, William, Rhoda, Margaret, John Pettis. Will proved 9 February 1802. Wilson in "Tinkling Springs," gives 30 January 1743 as birth date of this William Finley. Stout has fused him incorrectly with family of John and Thankful (Doak) Finley. Dabney Pettus will, (Charlotte Co., VA Book 1:407a) names Mary Finley daughter, 1 September 1788. George Dabney will, King Wm. Co., VA, 24 October 1729 names daughter, Mary Pettus (Virginia v. 21, no. 4, Oct-Dec 1977, p. 307-310).

!Baptised by Rev. John Tompson at Tinkling Spring. Probably moved with father to Prince Edward County in 1765. Bought 200 acres there from father- in-law, Thomas Fulton, 1769 (2:487). Wife Jane named in Order Book 5:335. Sold in 1773 and probably went to Montgomery County (now Wythe), VA. Fought in Dunsmore's War of 1774 (p. 196, 197).
!Married Mary (Polly) Gaines in 1786 (Lincoln Co., VA marriages). Recommended captain in KY militia, 1789 (KY Genealogist, vol. 15, no. 2 1973). On tax records in Madison Co., 1789, 1790. Bought 100 acres on Dicks River, 1797 (Lincoln Co., C:331). Sold in 1808 (Lincoln Co., F:113). Wife, Mary, sues for divorce, 1809 (Mercer Co., Circuit Court, box F-9). Moved to Wayne Co., KY and placed personal property in trust 4 Mar 1809, for Mary (Mercer Co., 7:229). Son, Obadiah took inventory of George's estate, 1817 (letter from Clerk's office, Wilson Co., TN, recorded 20 January 1818).

!A David Findly witnessed a deed between William Gaines and Strother Gaines in Mercer County, KY 4 November 1814 (Mercer County, KY Deeds, FHL-SL film #0191815) and also witnessed the marriage bond between William Pennebaker and Lucinda W. Findley, signed by Mary Finley, her mother on 22 September 1818 (Mercer County, KY Marriage Bonds, FHL-SL film #0191847). Could this David be a son of George by his first marriage?


General Notes for Child James Finley

!There were 2 or 3 James Finleys living in Montgomery/Wythe County, VA dating from 1773 when John and Mary (Caldwell) moved there. They show up in the Order Books as well as in deeds and surveys and are variously referred to as James, Sr.; James, Jr.; and Capt. James. A James Finley, Sr. left a will dated 23 July 1799, proved 10 August 1802 and named James, his only son. He also named William Finley, beloved grandson (Wythe County WB 1:220). There was also a Captain James Finley who left a will dated 15 October 1800, proved 15 April 1801. He named a son, William and a nephew, Jonathan Henderson (Wythe County WB 1:176). How these James' relate to this family is unknown at this time.
