Heinrich Hiestand Will - March 22, 1777
In the Name of God Amen. I Heinrich Hiestand residing in Dunmore County in the Province of Vi rginia do this twenty second day of March in the year of our Lord and Saviour Jesus Christ on e thousand seven hundred and seventy seven. Make known and declare this my Last Will and Test ament in good health and perfect understanding and memory. Thanks be to God for this benefice nce. This my Last Will and Testament I make in the following manner and form. To wit firstl y it is my will and I ordain that first of all my burial costs and all lawful debts shall b e paid from my estates. Item it is my will and confession and ordaining that my eldest son Jacob shall have five poun ds beforehand afterwards though shall receive equal inheritance with all my other children an d no more.
Item it is my will and ordaining that my son Jacob inherit my place, where I now should stil l reside, for [one] hundred and eighty pounds of money as it is current in Virginia after m y demise.
Item it is my will and ordaining what of my following property or money and is still remainin g of both that everything shall be equally and amiably shared after my death.
Item it is my will and ordaining that my five sons after my decease shall give out to my thre e daughters until they are all equal inheritance, however I ordain and it is my will that m y youngest daughter Magdalena shall have ten pounds less in her inheritance than the other ch ildren because of a reason which I now do not like to mention, and likewise my son Daniel sha ll likewise have ten pounds less inheritance than the six remaining because of the same reaso n which I now do not like to mention. Item it is my will and ordaining that my eldest daughter Barbara shall have nothing of this i nheritance so long as she lives with this man in wedlock but when she will be a widow so sh e shall have her share what comes to her by right like the six above mentioned children, bu t if she should die before her husband so her children shall have her inheritance instead a s they come of age further I declare what my daughter Barbara has received from her inheritan ce from me which amounts to forty pounds and twelve shillings, herewith I ordain and shall b e faithfully carried out that after my demise ten shillings from my estate shall be distribut ed to the poor.

3. Daniel Hiestand's brother, Abraham, did live in East TN in the late 1700s.
Abraham Hiestand left historical "tracks" in several places in East TN and into Kentucky. W e can only wish that Daniel Haston would have left a similar trail, prior to (and to) his Kno x Cty, TN sojourn. Abraham was born about 1740 (perhaps in Lancaster Cty, PA), as the thir d child of Heinrich Hiestand. He married Magdalene Boehm in about 1763. The next nearly 5 0 years of Abraham Hiestand's life can be summarized by this narrative timeline:
October 4, 1763--On this date, Abraham had 300 acres surveyed at the upper end of Powell's Fo rt in VA, above the Massanutten Path, although Lord Fairfax rejected his claim. On... March 22, 1777--Abraham Hiestand's (and Daniel Hiestand's) father made out his will. Four da ys later, on... March 26, 1777--Lord Fairfax granted Abraham 300 acres, which adjoined his father's farm. Th en, on... August 22, 1783--Abraham sold his land to James Breeding, and moved to Washington Cty, TN o f upper East TN sometime not long after that. Perhaps from the money received from that sale , on... September 25, 1785--Abraham bought 123 acres on both sides of Cherokee Creek from James Ray f or 100 pounds. And on... October 26, 1786--he received an additional 50 acres on the south side of Cherokee Creek fro m the state of North Carolina for 25 shillings. Note: There is no record of Abraham selling the land, although the 123 acres tract did end u p in the ownership of John Tadlock who sold it to Peter Rube on August 27 of 1793. February 1790 to June 1793--various members of the Hiestand family were active in the Cheroke e Creek Baptist Church in Washington Cty, TN (near Jonesborough, TN). Note: The microfilm copy of the Cherokee Creek Baptist Church is very difficult to read. I t has not been transcribed. Some of the names that appear there for sure are Betty Heaston , Ann Heaston, Daniel Heaston, Magdalene Heaston, and Abram Heaston (may be Abraham's son) . Washington Cty, TN Cherokee Baptist Church minutes, 1787-1923, microfilm AC #523 (McClun g Historical Collection, Knox Cty, TN).
1791--A tax list in Washington Cty, TN, includes the names of Abraham Heslin, junr and Abra m Heeslin, senr, who had 223 acres (and Samuel Hestain). Note: A Daniel Heston voted in Washington Cty, TN in 1786 and was on a tax list there in 178 7. He does not appear on this 1791 tax list for Washington Cty. See the 1787 entry of the D aniel Haston timeline for details.
Then, from... January 7, 1792 to August 4, 1798--this same family joins and becomes active in the Big Pigeo n Baptist Church in Cocke Cty, TN (approximately 50 miles south east of Jonesborough, TN, whi ch was a little over half way to Knoxville). Note: Ann Heaston, Betty Haston, Maagelean (and Magdeleum) Heaston, Abrm. Measton, Sr. (prob ably the older brother of Daniel Hiestand), Daniel Heaston/Haston, Abram Heaston/Haston (prob ably Abraham's son) appear in the minutes of the Big Pigeon Baptist Church in Cocke Cty, TN . These minutes have been transcribed and are available on the Cocke Cty, TN RootsWeb site.
Abraham and family then moved to Green Cty, KY, where on... June 14, 1799--Abraham claimed 200 acres of second rate land on Green River, by virtue of a c ertificate for settlement #744. (He had surveyed 100 acres on Green River.) In about... 1800--he moved to Barren (now Monroe) Cty, KY where in... April, 1801--he joined the Mill Creek Baptist Church near Tomkinsville by letter. Also in... 1801--he appointed Joel Moore his attorney to receive his share of the estate of his father-i n-lay, Samuel Boehm, in Shenandoah Cty, VA. On... June 18, 1803--Abraham Hastand an Abraham Hester were both on the Sevier County, TN delinquen t tax list for 50 aces each. Note: Sevier Cty is near Cocke Cty, TN.
