General Notes (Husband)
1. Henry had a brother William Scudder, living in 15 9 4 w h e n he made his will. It has been assumed that thi s w as t h e W illiam, yeoman, of Darenth, Kent, whose wil l dat ed Ju l y 27 , 1607, proved November 4, 1607, was abs tracte d by W at ers . In it, William named , wife Margery , daugh ters Pa rnel l, M argaret, Joan, and Mary, all evi dently u nder 21 ; dece ase d brothers John and Henry; brot her Henry 's son s Henry , Thom as, and John, and brother J ohn's so n Henry . One parc el of l and, Pricles Mead, wa s to rever t to hi s deceased br other Jo hn's son Henry i f all four d aughter s died withou t lawful is sue. A piec e of land o f that sam e name was amo ng the beque sts mad e by the Rev . Henry Scud der in 1652, bu t as record s sug gest that a t least three o f William's daug hters marri e d and had chi ldren, it is no t clear how Pricle s Mead w oul d have com e to Henry had th e terms of William ' s wil l bee n properl y observed. Willi am of Darenth in hi s wi ll aske d to b e buried in the churc hyard at Darenth " a s near as ma y b e unto my father's grav e."
Henry and William were probably the sons of a John Sc u d d e r who was dead by October 18, 1584, when his wido w Ma rg ar e t deeded property at Sutton at Hone and Horto n Kirb y t o h e r son Henry Scudder, carpenter; William Sc udder s igne d t h e "final concord" with her on "eighth da y of St . Mart in " 2 8 Eli. [19 Nov. 1585|. No will or bu rial rec ord ha s be en f ound for this John Scudder, and h e has no t yet be en cl earl y identified among all the pos sible me n of tha t name i n th e group of parishes in whic h Scudder s were li ving. H e may w ell be the father burie d at Daren th.
2. Henry must have been only in middle age at th e t i m e o f his death, for most of his children were stil l i n t he ir m inority. Calling himself "Henry Skudder o f Hort on K irh bie i n the county of Kent, yeoman," he req ueste d buria l i n the c hurchyard at Horton and bequeathe d 40 s hilling s t o his poo r neighbors of Horton to be di stribut ed at th e di scretion o f the minister and churc h wardens . In his w ill:
"unto my daughter Elizabeth one Angele to be deli v e r e d her presently after my decease... unto my daught e r Br id ge t fyve
pounds within two yeeres next after my decease. . . u n t o Alice my daughter tenne pounds [at date of marr ia g e o r a t 20 years

of my said daughters Alice Jane and Martha shall d e p a r te this liffe b[e]fore the tyme aforesaid wherein t h e y ou gh t to receave
their portions, then my will is that their said po r t i o ns shall remayne to be equally devided amongst th e m o r s o m any of them
which shalbe lyvinge then....yf yt so happen t h a t a l l my said daughters Jane Alice and Martha shall d ep ar te t hi s liffe before the

sonnes Henry, Thomas, and John...All residewe... u n t o E lizabeth my wiffe, whom I do ordayne and make th e s o l e Exec utrix..."
and it continues:
"to son Henry the mansion house wherein I nowe d w e l l , with all the tandem houses, and eddyfices whatsoe v e r th er eunto
belonging, together with the house in the Chalkd a l e , a nd all theire appurtenances whatsoever exceptin g on l y o ne a cre and
certain days worthe of land lying in my fee l d c a l led North Feeld which boundeth Joyce west. If He nr y di e d w ithout issue the
premises to go to son Thomas, and if Thomas di e d , t o y oungest son John; if all three sons died the da ug ht er s to d ivide the
property. To Thomas 'my other three tenemente s ' i n C h appell Green in the parish of Horton includi n g a hous e n o w in the tenure
of Tymothy Skudder, another occupied by Michall Pi c k w e ll with an acre of land, lately bought of John Maye he w e a n d a house in
the occupation of Christopher Harris with on e a c r e o f land adjoining the highway leading from Fawkh a m t o St . Ma ry Craye South,
and the lands of Thomas Walter east, and the testa t o r ' s lands north and west. If Thomas died without heir s , J o h n to inherit, and
if he also died, the property to go to the daugh t e r s . To son John a tenement and lands lately purchas e d o f Fr an cis Reeve, now in
the tenure of Thomas Adames, together with a n a c r e i n his field called North Feeld. If John died , th e pr op ert y to go to Thomas,
and if he died, to son Henry, reverting to the dau g h t e rs if all the sons died without heirs. His wife El iz ab e t h to have possession
of all lands until the sons reached 18 on condit i o n s h e bring the children up or cause them to be 'dece nt l y an d o rderly brought up
according to law and consyence'. If his wife di e d b e f ore the sons reached 18, 'John Humfry, the elder , m y br ot he r William
Skudder, and Anthony [Comfot?] to have the u s e o f t h e lands and children s portions for bringing th e m up."
Witnesses John Swarland, Vicar of Horton Kirbie, Joh n F o s t er, Christopher Hacock .
3. Henry's three sons may well be the same three who r e c e i ved Conditional bequests in the will of William Scu d d e r o f Darenth in 1607, but their names, even in combi na ti o n wer e too common to stand as conclusive proof o f th e re la tionsh ip.

General Notes for Child Thomas Scudder Sr.
Thomas' will was dated 30 September 1657 and proba t e d 2 9 J une 1658.
There is tentative and highly ambiguous evidence that T h o m as Scudder may have departed Kent after 26 March 16 3 7 t o a v oid possible loss of a suit for heavy damages a ga ins t hi m , going first to Colingbourne-Ducis(the hom e o f h i s brot her, Reverend Henry Scudder), and then t o Amer ica.Th e evide nce is contained in the report of a d amage s uit i n Chancer y C ourt in 1640 (several years aft er Thoma s' dep arture) in volving Sir Henry Neese and hi s wife, pet itioner s, agains t Mr. Chase, clergyman, and h is father an d brothe rs. Sir H enry asserted that while h e and his wif e were te mporarily i n London, Mr. Chase e t al seized Si r Henry's dw elling in St one , Kent, calle d Stone Castle ( about four mi les north o f Horton-Kirby) , for a fortnight , consuming o r embezzling h is possessio ns,and denying hi m access or pos session. Durin g this per iod, Sir Henryleas ed a second hous e, in Horton-Ki rby, ap parently owned by T homas Scudder, i n which to live . Si r Henry further mainta ined that the Cha ses, in "pursu i t of their malice agains t him, " secretly c onspired wit h He nry Scudder, clerke, a nd the said Thomas S cudder o f Ho rton-Kirby , to deny Si r Henry access to the s econ d house a s well , in order t o carry out their threat " t o drive him o ut of that countr y." By the time of the 16 4 0 Chancery case , Sir Henry ha d regained possessio n o f Stone Castle an d had recovered 3 0 pounds in damage s fro m the Chases throug h "five or si x courts of law an d equity ." The apparent purp ose of th e 1640 action was c hiefly t o enable Sir Henry to r ecove r additional damage s to cove r his costs, which he clai me d in one stat emen t to amoun t in excess of "treble the s a id 30 pounds, " a nd others t o total in excess of 300 pou nds.
Thomas Scudder was also known as "Old Goodman Scudd e r " i n his community.

Francis Joseph I; Reign: Emperor of Austria 1848-1916; King of Hungary 1867-1916; the last important ruler of the Habsburg dynasty; his policies played a major role in the events that led to World War I. Beginning in the 1870's, Austria-Hungary gradually became subservient to its powerful neighbor and ally, the Prussian dominated German Empire. Franz Josef's later years were marked by a series of family tragedies. In 1889 his only son and heir, Archduke Rudolf, committed suicide. In 1898 his wife was assassinated by an Italian anarchist; and, in 1914 his nephew, Francis Ferdinand, who had replaced Rudolf as heir to the throne, was assassinated by a Serbian nationalist. The murder of Francis Ferdinand added to the crisis between Austria-Hungary and Germany and Servia and Russia and subsequent events led to World War I.
